REQUESTFOR COUNCIL ACTION <br />Date:August 24, 2020 <br />Item No.: 7.b <br />Department ApprovalCity Manager Approval <br />Item Description:Discussion regarding the regulation of short term rentals <br />1 B ACKGROUND <br />2Over the course of the last summer, several complaints have been received regarding offensive <br />3activities occurring at homes that are rented on short-term bases. Those offensive activities <br />4include loud parties, excessive parking, noise (including offensive language), and drug use. As a <br />5result of those complaints, and requests by residents impacted by short-term rentals, the City <br />6Council requested staff to research options for the possible regulation ofshort-term rentals. <br />7 <br />8Currently, there are553 registered rentals in Roseville. A cursory search of short-term rental <br />9platforms has revealed advertisements for 24 short-term rentals in the City, with most being a <br />10rental of a single room within an otherwise owner-occupied residence. <br />11 <br />12 1. Differentiating Short-Term Rentals fromLong Term Rental <br />13Currently, Chapter 907 of the City Code requires registration for a propertywith 1-4 unitsthat is <br />14rented for any duration. Research of rental ordinances innational municipalities shows a wide <br />15range of days rented that differentiate between rental types. Most localcities, including <br />16Roseville,do not differentiate based on durationof rental. As such, whether one rents a bedroom <br />17or an entire house, for a weekend or a year, that unit must register with the City in accordance <br />18with City Code, Title 9, Chapter 907. The primary purpose of the registration process is to <br />19gather responsible party contact information so that if/when a problem arises contact can be <br />20made by City staff more easily. The registration also allows fordissemination of educational <br />21materials regarding City and State safety, health, fire protection, maintenance and zoning codes <br />22within the City. <br />23 <br />24 2.Current Rental Code <br />25Roseville currently utilizes two different chapters of code to regulate rental propertieswithin the <br />26City: Chapter 907 –Rental Registration,and Chapter 908 -Rental License. <br />27907 –applies to buildings with 1-4 units, registration required <br />28908 –applies to buildings with 5 or more units, license required <br />29 <br />30Both Chapters907 and 908 reference additional standards for code compliance in current City <br />31Ordinance. These include; Chapter 405 –Noise Control; Chapter 407 –Nuisances; Chapter 906 <br />32–Building Maintenance and Preservation; Title 10 –Zoning. These Ordinances provide for <br />33regulation on all property in Roseville, however,due to the use of specific properties in a short- <br /> <br />
