Attachment A 1 PUBLIC IMPROVEMENT CONTRACT 2 OWASSO GARDENS 3 I. Parties.This Agreement, dated ____________________, 2020, is entered into between the City of 4 Roseville, a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, 5 Minnesota 55113 (the “City”), and CB Owasso Gardens Limited Partnership, a Minnesota limited 6 partnership, whose address is 1080 Montreal Avenue, St. Paul, MN 55116 (the “Developer”). 7 II.Request for Permit approval. The Developer has asked the City to approve a building permit to 8 develop the site, “Owasso Gardens”. The land is legally described as set forth in Exhibit A (the 9 “Property”). 10 III. Terms and Conditions of Permit Approval. For good and valuable consideration, the receipt and 11 sufficiency of which are hereby acknowledged, the parties agree as follows: 12 Permit Approval.Subject to the terms and conditions of this Public Improvement Contract, the 13 recitals above, and all other applicable City Code provisions, the City hereby approves the recording 14 of the Plat of Owasso Gardens as approved by the City Council of the City of Roseville on July 27, 15 2020 (the “Plat”). 16 Land Use. To construct, or cause to be constructed, a multifamily rental housing facility consisting 17 of approximately 60 senior rental housing units, including a new parking lot, private utilities, storm 18 sewer and construction of a public sidewalk along South Owasso Boulevard and Rice Street. 19 Public Improvements. The Developer shall, subject to the terms and conditions contained herein, 20 perform the following work and construct the following improvements, all or portion of which are to 21 be constructed onthe real property of the City (“Public Improvements”) in compliance with the 22 Plans, as defined in Section III Ebelow and all rules, regulations, standards and ordinances of the City: 23 1. Sidewalk construction: The Developer shall construct new, public sidewalks along South 24 Owasso Boulevard West and along Rice Street as more specifically provided in the Plans, to be 25 maintained by the City following the City’s acceptance of the Public Improvements pursuant to 26 this Agreement. 27 2. Restoration of existing streets: If applicable, curb cuts and street cuts shall be reconstructed to 28 match the existing street section. 29 3. Curb openings: All unused curb openings on the Property along the South Owasso Boulevard 30 and Rice Street curb line shall be removed and replaced with non-surmountable curb to match the 31 existing curb. Curbs proposed to be replaced shall have a minimum of 3 feet of bituminous saw 32 cut out to allow for proper compaction. Page 1 of 15
