Attachment A <br />1 PUBLIC IMPROVEMENT CONTRACT <br />2 OWASSO GARDENS <br />3 I. Parties.This Agreement, dated ____________________, 2020, is entered into between the City of <br />4 Roseville, a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, <br />5 Minnesota 55113 (the “City”), and CB Owasso Gardens Limited Partnership, a Minnesota limited <br />6 partnership, whose address is 1080 Montreal Avenue, St. Paul, MN 55116 (the “Developer”). <br />7 II.Request for Permit approval. The Developer has asked the City to approve a building permit to <br />8 develop the site, “Owasso Gardens”. The land is legally described as set forth in Exhibit A (the <br />9 “Property”). <br />10 III. Terms and Conditions of Permit Approval. For good and valuable consideration, the receipt and <br />11 sufficiency of which are hereby acknowledged, the parties agree as follows: <br />12 Permit Approval.Subject to the terms and conditions of this Public Improvement Contract, the <br />13 recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />14 of the Plat of Owasso Gardens as approved by the City Council of the City of Roseville on July 27, <br />15 2020 (the “Plat”). <br />16 Land Use. To construct, or cause to be constructed, a multifamily rental housing facility consisting <br />17 of approximately 60 senior rental housing units, including a new parking lot, private utilities, storm <br />18 sewer and construction of a public sidewalk along South Owasso Boulevard and Rice Street. <br />19 Public Improvements. The Developer shall, subject to the terms and conditions contained herein, <br />20 perform the following work and construct the following improvements, all or portion of which are to <br />21 be constructed onthe real property of the City (“Public Improvements”) in compliance with the <br />22 Plans, as defined in Section III Ebelow and all rules, regulations, standards and ordinances of the City: <br />23 1. Sidewalk construction: The Developer shall construct new, public sidewalks along South <br />24 Owasso Boulevard West and along Rice Street as more specifically provided in the Plans, to be <br />25 maintained by the City following the City’s acceptance of the Public Improvements pursuant to <br />26 this Agreement. <br />27 2. Restoration of existing streets: If applicable, curb cuts and street cuts shall be reconstructed to <br />28 match the existing street section. <br />29 3. Curb openings: All unused curb openings on the Property along the South Owasso Boulevard <br />30 and Rice Street curb line shall be removed and replaced with non-surmountable curb to match the <br />31 existing curb. Curbs proposed to be replaced shall have a minimum of 3 feet of bituminous saw <br />32 cut out to allow for proper compaction. <br />Page 1 of 15 <br /> <br /> <br />
