Attachment A <br />1 4. Erosion control: Prior to the commencement of any grading and before any utility construction <br />2 is commenced, the erosion control planthat is a part of the Plansmust be implemented, inspected <br />3 and approved by the City. The Developer shall meet all requirements of the City’s Erosion Control <br />4 Ordinance including but not limited to the following: <br />5 a)No construction activity shall be allowed unless the Property is in full compliance with <br />6 the erosion control requirements. <br />7 b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />8 c)The City will inspect the site periodically and determine whether it is necessary to take <br />9 additional measures to address erosion. The Developer shall comply with all additional <br />10 erosion control requirements. <br />11 d) To remove dirt and debris from streets that has resulted from construction work by the <br />12 Developer, its agents or assigns, the Developer shall sweep South Owasso Boulevard and <br />13 Rice Street in the immediate vicinity of the Property on an as-needed basis ormore <br />14 frequently as reasonably directed by the City Engineer until the site is stabilized. The <br />15 Developer must sweep roadways with a water-discharge broom apparatus. Kick-off <br />16 brooms shall not be utilized for street sweeping. <br />17 e)If the development on the Property does not comply with the erosion control plan that <br />18 is included in the Plans or supplementary instructions received from the City, the City may, <br />19 following giving the Developer 48-hour prior verbal notice (or immediately in the case of <br />20 an emergency), take such action as it reasonably deems appropriate to control erosion, the <br />21 cost of which action shall be paid by the Developer to the City upon demand. <br />22 Private Improvements.The Developer shall, subject to the terms and conditions contained herein, <br />23 perform the following work and construct the following improvementson the Property(“Private <br />24 Improvements”) in compliance with the Plans described in Section III E below and all rules, <br />25 regulations, standards and ordinances of the City: <br />26 1. Site Grading and Turf Restoration. The Developer shall grade the Property in accordance with <br />27 the Grading, Drainage and Erosion Control Plan that is included with the Plans. Site grading <br />28 improvements shall include common excavation, subgrade correction, embankment and pond <br />29 excavation. The Developer shall conduct turf restoration on the Property which shall include <br />30 seeding, mulching and erosion control. <br />31 a)The Developer shall submit to the City a site grading and drainage plan for the entire <br />32 Plat acceptable to the City showing the grades and drainage for each lot prior to installation <br />33 of the improvements. <br />34 b) The Developer shall furnish the City Engineer satisfactory proof of payment for the site <br />35 grading work and shall submit a certificate of survey (as-constructed survey) of the <br />36 development to the City after site grading, with street and lot grades. <br />37 c)All improvements to the lots and the final grading shall comply with the Grading, <br />38 Drainage and Erosion Control Plan that is included in the Plans. <br />39 2. Water / Sanitary Sewer: The Developer shall construct water and sanitary sewer pipes from <br />40 the Property line to connect to the City water mainand sewer main pursuant to the Plans and in <br />41 accordance with City details, specifications, and the Plans. <br />Page 2 of 15 <br /> <br /> <br />
