REQUEST FOR COUNCIL ACTION <br />Date: October 12, 2020 <br />Item No.: 7.c <br />Department Approval City Manager Approval <br />Item Description: Public Hearing to Consider Resolution Approving the Vacation of Excess <br />Right-of-Way at 2501 Fairview Avenue <br />1 B ACKGROUND <br />2 As part of the City’s ongoing effort to sell the old Fairview Fire Station at 2501 Fairview Avenue, <br />3 the City Attorney has recommended to the City that excess Fairview Avenue Right-of-Way be <br />4 vacated as part of a larger effort to ensure clean title for a prospective buyer. <br />5 The portion of the easement being vacated was acquired by Ramsey County in 1973 as additional <br />6 right-of-way for Fairview Avenue. Upon review in 2018 of title for the Fairview Fire Station <br />7 property, the City believed excess right-of-way was acquired on the subject property, and requested <br />8 that it be released by Ramsey County. In order to release 26.5 feet of the right-of-way, Ramsey <br />9 County granted a Quitclaim Deed dated June 14, 2018, which was filed with the office of the <br />10 Ramsey County Recorder on June 26, 2018, as Document No. A04715333. This easement vacation <br />11 is being conducted to confirm that the right-of-way is not considered a City right-of-way upon <br />12 acceptance of Ramsey County’s Quitclaim Deed. <br />13 Since this is a City-initiated vacation, a four-fifths vote is required to complete the vacation. <br />14 The vacation will be not be official until such time as the City Manager executes and records a <br />15 Notice of Completion of this vacation. <br />16 F INANCIAL I MPACTS <br />17 There is no financial impact to the City of Roseville. <br />18 S TAFF R ECOMMENDATION <br />19 Approve a resolution approving the vacation of excess right of way adjacent to Fairview Avenue. <br />20 R EQUESTED C OUNCIL A CTION <br />21 Conduct a public hearing receiving any public comments related to the proposed right-of-way <br />22 vacation. <br />23 Consider approval of a resolution approving the vacation of excess right of way adjacent to Fairview <br />24 Avenue. <br />Prepared by: Jesse Freihammer, City Engineer/Assistant Public Works Director <br />Attachments: A: Resolution <br /> B: Public Hearing Agenda <br /> C: Right-of-Way Vacation Sketch <br /> D: Proposed Fairview Fire Station Plat <br />Page 1 of 1 <br /> <br />
