Attachment A <br />EXTRACT OF MINUTES OF MEETING <br />OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />* * * * * * * * * * * * * * * * * <br />1 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />2 Roseville, County of Ramsey, Minnesota, was duly held on the 12 day of October, 2020, at <br />3 6:00 p.m. <br />4 The following members were present: , , , , and Mayor , and <br />5 the following were absent:. <br />6 Councilmember introduced the following resolution and moved its adoption: <br />7 RESOLUTION NO. <br />8 APPROVING THE VACATION OF EXCESS RIGHT-OF-WAY ADJACENT TO <br />9 FAIRVIEW AVENUE <br />10 WHEREAS, the Roseville City Council has determined on its own motion to vacate a portion <br />11 of former county highway easement, on, over, and across the real property legally described in <br />12 the attached Exhibit A (the “ROW”); and <br />13 WHEREAS, the portion of the easement being vacated was acquired by Ramsey County in <br />14 1973 as additional right-of-way for Fairview Avenue and is located on the City’s property <br />15 formerly used as the Fairview Fire Station; and <br />16 WHEREAS, upon review in 2018 of title for the Fairview Fire Station property, the City <br />17 believed excess right-of-way was acquired on the subject property, and requested that it be <br />18 released by Ramsey County; and <br />19 WHEREAS, in order to release 26.5 feet of the right-of-way, Ramsey County granted a <br />20 Quitclaim Deed dated June 14, 2018, which was filed with the office of the Ramsey County <br />21 Recorder on June 26, 2018, as Document No. A04715333; and <br />22 WHEREAS, this easement vacation is being conducted to confirm that the ROW is not <br />23 considered a City right-of-way upon acceptance of Ramsey County’s Quitclaim Deed; and <br />24 WHEREAS, after two weeks published and posted notice have been given as well as notice <br />25 having been mailed to all affected property owners according to Minnesota Statutes, a public <br />26 hearing was held on October 12, 2020, at which time all persons interested in said vacation <br />27 were given an opportunity to be heard; and <br />28 WHEREAS, the Roseville City Council has determined that the vacation would be in the <br />29 public interest; and <br />30 WHEREAS, at least four-fifths of all members of the City Council concur in this resolution. <br /> <br />
