Attachment B <br />modifications and improvements contemplated by the City of Rosevillewill have no adverse <br />impact on properties which rely upon Ramsey County Ditch 4 as an outlet for surface drainage or <br />to properties that otherwise benefit from the existence of Ramsey County Ditch 4. <br />13. In preparing this report, the engineer studied, evaluated and reported on the nature <br />and extent of the drainage easement occupied by the drainage system and the as constructed, or <br />subsequently improved, depth, grade, and hydraulic capacity of the drainage system. <br />14. By this Petition, the City of Roseville seeks to be the water management authority <br />to which the portions of Ramsey County Ditch 4, referenced above, would be transferred. <br />15. The City of Roseville understands that pursuant to Minn. Stat. §103E.812, subd. <br />6, all costs, including engineering and attorney’s fees, related to the proceedings to transfer the <br />drainage system will be paid by the City of Roseville as the transferring water management <br />authority. Pursuant to the statutory requirement, the City of Roseville pledges its surety to repay <br />the costs of the transfer proceedings upon completion of the proceedings, whether or not the <br />transfer of the Ramsey County Ditch 4 is actually ordered. The City’s pledge is subject to and <br />modified by its Memorandum of Agreement with the Rice Creek Watershed District which <br />details cost commitments and limitations related to both the joint, modified repair of Ramsey <br />County Ditch 4 and the proposed transfer. <br />16.
