Non-residential Fences: In addition to the requirements of this section, fences in all <br />non-residential districts shall conform to the screening requirements of Section <br />1011.03B of this Chapter. <br />11. Fencing of Play Areas: For public or private parks and playgrounds located adjacent <br />to a public right-of-way or railroad right-of-way, a landscaped yard area no less than 30 <br />feet in width or a fence no less than 4 feet in height shall be installed between the <br />facility and the right-of-way. <br />B. Residential Fences: The following standards shall apply to all fences constructed in any <br />residential zoning district <br />1. No fence used for screening or security shall exceed 6.5 feet in height; <br />2. Fences shall be comprised of chain-link, wood, plastic, or metal, but shall not be <br />barbed wire, electric, weaved or welded wire <br />3. Exception: Weaved or welded wire or mesh fences erected at the periphery of a <br />garden and used to keep unwanted animals out of the garden shall be allowed to a <br />maximum of 8 feet in height. (Ord. 1436 5-13-13) <br /> <br />1009.01: ADMINISTRATIVE DEVIATION <br /> <br />3. Fence Height Deviation: A fence height deviation is an increase of the required fence height <br />limit to allow for better screening and/or noise reduction adjacent to highway rights-of-way, <br />busy commercial areas, or other unusual properties. A fence height deviation shall not allow <br />fences in excess of 8 feet in height. <br /> <br />E. Considerations for Approval: <br />3. Fence Height Deviation: In addition to other requirements of this section, the ADC shall <br />consider the unique circumstances surrounding an applicant’s property prior to recommending <br /> <br />approval or denial of a fence height deviation. <br /> <br /> <br />
