ATTACHMENT B <br />193 D.G&G Management LLC shall take no retaliatory actions against tenants for <br />194 reporting in the past or in the future conditions of the Marion Street/The Brittanys <br />195 Apartments to the City. <br />196 E.G&G Management LLC upon revocation shall provide the current occupancy <br />197 register to ensure compliance with condition F below and shall further give the City <br />198 regular access to the occupancy register of the Marion Street/The Brittanys <br />199 Apartments so that vacant units can be monitored by the City to ensure that no <br />200 vacant units are rented during the time of the license revocation. <br />201 F.G&G Management LLC shall display placards provided by the City on the exterior <br />202 of each building of the Marion Street/The Brittanys Apartments, and upon each <br />203 individual unit that becomes vacant, that states the multi-family rental license is <br />204 revoked. <br />205 G.Moving forward, G & G Management LLC shall employ a certified residential <br />206 manager and certified residential maintenance technician through Minnesota Multi <br />207 Housing Association, or an equivalent training and approved by City inspectors in <br />208 accordance with City Code Licensing requirements provided in Section 908.03 (I) <br />209 in order to restore and maintain the multifamily rental license issued by the City for <br />210 the Marion Street/The Brittanys Apartments. <br />211 H.The City Council may consider restoring the multi-family rental license for <br />212 individual buildings if it is determined that all code violations for that building and <br />213 units within it have been corrected and G & G Management LLC has demonstrated <br />214 an ability to comply with City Code Section 908.07 by continuously complying <br />215 with all applicable property maintenance, zoning health, building, nuisance, or <br />216 other City Codes. Such request shall be made in accordance with Section 908.07 <br />217 (G)_ (3), which entails new applications and payment of applicable fees. <br />218 I.The City reserves the right to take additional legal action against G&G <br />219 Management LLC, as provided in City Code Section 908.04 (D), if there is not <br />220 sufficient timely progress in correcting the identified code violations. <br />221 J.If other code violations are found in the Marion Street/The Brittanys Apartments <br />222 while the multi-family rental license is revoked, they must also be corrected and <br />223 G&G Management LLC is subject to the same conditions as contained in this <br />224 resolution when correcting new code violations. <br />225 <br />226 BE IT FURTHER RESOLVED, G & G Management LLC, in accordance with City Code <br />227 Section 908.08 has the right to appeal any licensing decision, including said revocation, as <br />228 long as such appeal is submitted to the City within 30 calendar days after the making of <br />229 the order or decision being appealed. Said appeal shall state the specific grounds upon <br />230 which the appeal is made and the appeal is accompanied by the fee set forth in Chapter 314 <br />231 of the City Code. <br />232 <br />233 The motion for the adoption of the foregoing resolution was duly seconded by Member <br />234 Etten, and upon a vote being taken thereon, the following voted in favor thereof: Laliberte, <br />235 Etten, Willmus, Groff, and Roe and the following voted against: None. <br />236 <br />237 WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />
