REQUEST FOR COUNCIL ACTION Date:February 8,2021 Item No.:7.b Department Approval City Manager Approval Item Description: Consider approval of ordinance amending City Code Chapter 306 (Cigarette and Tobacco Products) including restricting the sale of flavored tobacco products in the City of Roseville 1 B ACKGROUND 2 At the January 11, 2021 meeting the City Council reviewed and discussed a proposed ordinance that 3 would restrict the sale of flavored tobacco products in Roseville. The City Council also received 4 testimony from the public and retailers regarding the proposed ordinance. Draft minutes from the 5 January 11 meeting are included as Attachment A. 6 7 After discussion and consideration of motions, the City Council approved bringing back an 8 ordinance that prohibits the sale of flavored tobacco except in tobacco retailers that prohibit persons 9 under the age of 21 from entering, displays signage restricting entry, and derive at least 90% of its 10 revenue from the sale of tobacco and tobacco-related products. In addition, the City Council 11 indicated that the total amount of retailers exempt from the restrictions on selling flavored tobacco 12 products shall be limited to a total of 4. 13 14 Based on that direction, staff proposed making the changes as shown on the draft ordinance shown 15 as Attachment B described below (yellow highlight indicates new language from the January 11 16 draft): 17 18 Modify and add definitions to Chapter 306.2 DEFINITIONS 19 o RETAIL ESTABLISHMENT: Any place of business licensed under this Chapter 20 where tobacco licensedproducts are available for sale to the general public. This 21 phrase includes but is not limited to grocery stores, convenience stores, gasoline 22 service stations, pharmacies,bars, and restaurants, but does not include Age- 23 Restricted Tobacco Retailers. 24 o AGE-RESTRICTED TOBACCO RETAILER: An RetailEestablishment licensed 25 under this Chapter which: 26 Prohibits persons under 21 years of age from entering the establishment at all 27 times; 28 Posts conspicuous written notice advising of the prohibition such age 29 restriction at all entrances to the establishment; and 30 Derives at least 90 percent of its revenues from the sale of licensed products. 31 Amend Chapter 306.03 LICENSE REQUIRED 32 o M. The number of licenses issued under this Chapter to Age-Restricted Tobacco 33 Retailers shall not exceed four (4) at any time.
