35 <br />36 <br />37 Amend Chapter 306.6 PROHIBITED SALES <br />38 A. In general. Noperson shall sell oroffer to sellanylicensedproduct: <br />39 4. No person shall allow the sale oftobacco productsBby self-service merchandizing <br />40 wherebythecustomermayhaveaccesstothoseproductswithouthavingto <br />41 requesttheproductsfromthelicenseeorlicensee’semployeeandwherebythere <br />42 isnotaphysical exchange ofthe licensed tobacco product between the licensee or <br />43 licensee’semployeeand the customer. All tobacco licensed products must be <br />44 stored behind the sales counter or other area not freely accessible to customers, or <br />45 in a case or other storage unit not left open and accessible to the general public. <br />46 (Ord.1133, 1- 24-94) Provided, however, the requirements of this section shall <br />47 not apply toAge-Restricted Tobacco Retailers. as herein defined establishments <br />48 which: <br />49 a. Prohibit persons under21 years of age fromenteringthe <br />50 establishment atalltimes; <br />51 b.Post notice advising of theprohibition at allentrances tothe <br />52 establishment;and <br />53 c. Derive atleast 90 percent of their revenuesfromthe sale of tobacco and <br />54 tobacco- related licensed products. (Ord. 1555, 6-18-2018) <br />55 C. Flavored products. No person shall sell or offer for sale any flavored products., except <br />56 Age-Restricted Tobacco Retailers as herein defined. <br />57 <br />58 <br />59 The Association on Non-Smokers, in conjunction with the Hamline-Mitchell Law School Public <br />60 Health Law Center provided staff some additional restrictions regarding the sale of flavored tobacco <br />61 products to be considered as part of the ordinance (Attachment C). Staff will be prepared to discuss <br />62 their suggestions at the City Council meeting. <br />63 <br />64 Staff has prepared a non-redlined version of the ordinance as Attachment D and an ordinance <br />65 summary as Attachment E. <br />66 <br />67 P OLICY O BJECTIVE <br />68 One of Roseville’s Community Aspirations is to be a “Physically and mentally active and healthy” <br />69 community. Tobacco use is the leading cause of preventable death in the United States. <br />70 B UDGET I MPLICATIONS <br />71 The fee for a Cigarette and Tobacco Sales License is $200.00 annually. Roseville has issued 26 <br />72 Cigarette and Tobacco Sales Licenses for 2021 <br />73 E QUITY C ONSIDERATIONS <br />74 Use of tobacco products leads to serious health issues. According to the Centers of Disease Control <br />75 (CDC), there are disparities in tobacco use across groups defined by race, ethinicty, educational <br />1 <br />76 level, and socioeconomic status. In addtion, the CDC statesthat tobacco companies have <br />2 <br />77 aggressively marketed menthol products to young people, African Americans, and the LGBT <br />3 <br />78 community. <br /> <br />
