As this is looked <br />810 at, it needs to be looked at first as a public health piece. He agreed with the findings <br />811 of fact and purpose that are in the draft ordinance. He was supportive of those <br />812 things but was interested in discussing the allowance of some stores, for example, <br />813 tobacco-only product places. Places that sell 90 percent or more of products that <br />814 are tobacco related products. In a sense, those are stores that cannot recover any <br />815 other funds. One of the notes between City staff and retailers was that a lot of <br />816 customers walk to their locations because they do not have cars and he thought that <br />817 was an accessibility issue that has been brought up by a lot of public health folks. <br />818 If it is not available, then it is much less likely that they will start. He stated he was <br />819 open to the motion on the floor and open to a slight opening on the other side of <br />820 that motion. <br />821 <br />822 Mayor Roe indicated motions to amend are acceptable. <br />823 <br />824 Councilmember Willmus indicated he was a little bit up in the air. He explained <br />825 he was one that came out very strongly with respect to vaping accessibility to those <br />826 products. He was somewhat curious if the Council were to look at an approach <br />827 where these products were eliminated unless they are looking at a tobacco shop, <br />828 where the vast majority of that revenue is coming from tobacco sales. That leads <br />829 him into the question he had at the onset of this conversation and that is, he would <br />830 not want to see a significant expansion of tobacco-only shops in the City of Rose- <br />831 ville. He would want to look at a component of that where there is some regulation <br />832 on the number of licenses. He thought there might be further conversation for the <br />833 Council to have. <br />834 <br />835 Mayor Roe offered an amendment to the motion. <br />836 <br />837 Roe moved, Willmus seconded, an amendment to the Ordinance to exempt tobacco <br />838 shops where 90 percent of their business or more are from tobacco and are over 21 <br />839 as outlined in City Code 306.06 A4. Those establishments would be exempt from <br />840 the flavor sales ban. In addition, the motion includes the limitation of that particular <br />841 type of license in the City of Roseville to no more than 4. <br />842 <br />843 Council Discussion <br />844 <br />845 Mayor Roe thought the Council has a challenge here and it is very similar to the <br />846 challenge associated with regulating the sale of liquor. Those are legal products <br />847 that are heavily regulated as industries by other entities besides the City of Rose- <br />848 ville, and as mentioned they are a significant tax system for are significantly taxed <br />849 by the State and Federal governments. He thought that providing limited availabil- <br />850 ity in the City of Roseville through tobacco-only shops of this type of product, <br /> <br />
