Attachment A <br />Regular City Council Meeting <br />Monday, January 11, 2021 <br />Page 22 <br />940 was a huge step in the right direction and he wanted to see what Tobacco 21 (T21), <br />941 which was just signed into law at the end of the Spring in 2020 does and to also see <br />942 what that does for reducing availability of these products by 20 shops. Without a <br />943 Statewide ban, he did not think they would make as much progress as they wanted <br />944 to make but this cuts a little different. He noted he was not interested in tax revenue <br />945 and this will dramatically reduce access and availability. <br />946 <br />947 Mayor Roe noted that he understood all of the arguments related to the health, re- <br />948 lated to the access by young people, and also related to equity. He appreciated the <br />949 equity issue and hoped the notion of eliminating mint and menthol sales, which are <br />950 currently available in convenience stores, grocery stores, drug stores and liquor <br />951 stores, eliminating that accessibility gets to that issue. It is not a complete solution, <br />952 but he thought it is a significant change from where the City is right now and a step <br />953 in the right direction in terms of the equity issue. He also wanted to make it clear <br />954 that the limitation for licenses for the 90 percent revenue from tobacco is very im- <br />955 portant to him and the notion that the City is not going to see that situation that St. <br />956 Paul has seen with an increase of tobacco shops because the City will be putting a <br />957 cap on the number of licenses. <br />958 <br />959 Mr. Trudgeon indicated he would like, at some point, direction on the language and <br />960 where this is to be put in the Ordinance. He also would like to have the City Attor- <br />961 ney weigh in as necessary on this. <br />962 <br />963 Mayor Roe explained he did not have specific language drawn up because he was <br />964 not sure if the City Council wanted this to come back with specific language for <br />965 consideration. He noted there is not an Ordinance summary in the packet, which <br />966 would need to be adopted at some point. <br />967 <br />968 City Attorney Gaughan explained the effective date provision does require an Or- <br />969 dinance summary so even if the Council did pass something tonight, as a matter of <br />970 process this would have to come back at a future date for a 4/5 vote. <br />971 <br />972 Mayor Roe explained his suggested language is a definition of a tobacco retailer. <br />973 A tobacco retailer would be defined as a licensed establishment which; using the <br />974 three bullet points from Chapter 306.06 A4 as the criteria, prohibits entry to people <br />975 under 21; post notice advising of the prohibition at all entrances; and derive at least <br />976 90 percent of their revenues from the sale of licensed products. He noted as a part <br />977 of the provision, he would add a sentence that says a maximum of four (4) tobacco <br />978 licenses may be issued by the City of Roseville to tobacco retailers. He also sug- <br />979 gested in order to clean things up in Chapter 306.06 A4, to replace listing all those <br />980 criteria because they are in the definition with a sentence stating the exemption of <br />981 flavored tobacco. <br />982 <br />983 City Attorney Gaughan advised if that is a material enough change to the previous <br />984 proposed ordinance, it should come back with final language inserted for passage. <br /> <br />
