Attachment B <br />284 the following: <br />285 1.The applicant is under 21 years of age. <br />286 2. The applicant has been convicted within the past five years of any violation of a <br />287 federal, state, or local law, ordinance provision, or other regulation relating to <br />288 Licensed Products. <br />289 3. The applicant has had a license to sell Licensed Products suspended or revoked within <br />290 the preceding 12 months of the date of application. <br />291 4. The applicant fails to provide any of the information required on the licensing <br />292 application, or provides false or misleading information. <br />293 5. The applicant is prohibited by federal, state, or other local law, ordinance, or other <br />294 regulation from holding a license. <br />295 B. Except as may otherwise be provided by law, the existence of any particular ground for <br />296 denial does not compel the city to deny the license. <br />297 C. If a license is mistakenly issued or renewed to a person, it will be revoked upon the <br />298 discovery that the person was ineligible for the license under this ordinance. The city <br />299 will provide the license holder with notice of the revocation, along with information <br />300 on the right to appeal. <br />301 306.06 PROHIBITED SALES: <br />302 A. In general. No person shall sell or offer to sell any Licensed Product: <br />303 1. No person shall sell, offer to sell, or give away any tobacco related <br />304 product to any person under the age of 21 years. (Ord. 1555, 6-18-2018) <br />305 2.1. No person shall sell or dispense any tobacco product through the useBy <br />306 means of a vending machine. (Ord. 1555, 6-18-2018) <br />307 <br />308 3.2. By means of loosies as defined. <br />309 <br />310 3. Containing opium, morphine, jimson weed, bella donna, strychnos, cocaine, <br />311 marijuana, or other deleterious, hallucinogenic, toxic, or controlled <br />312 substances except nicotine and other substances found naturally in tobacco or <br />313 added as part of an otherwise lawful manufacturing process. It is not the <br />314 intention of this provision to ban the sale of lawfully manufactured cigarettes <br />315 or other products subject to this ordinance. <br />316 <br />317 4.4. No person shall allow the sale of tobacco products Bby self-service <br />318 merchandizing whereby the customer may have access to those products <br />319 without having to request the products from the licensee or licenseeÓs <br />320 employee and whereby there is not a physical exchange of the <br />321 licensedtobacco product between the licensee or licenseeÓs employee and the <br />322 customer. All tobacco Licensed Products must be stored behind the sales <br />323 counter or other area not freely accessible to customers, or in a case or other <br />324 storage unit not left open and accessible to the general public.
