Attachment D <br />244 federal,state, or local law, ordinance provision, or other regulation relating to <br />245 Licensed Products. <br />246 3.The applicant has had a license to sell Licensed Productssuspended or revoked within <br />247 the preceding 12 months of the date of application. <br />248 4.The applicant fails to provide any of the information required on the licensing <br />249 application, or provides false or misleading information. <br />250 5.The applicant is prohibited by federal, state, or other local law, ordinance, or other <br />251 regulation from holding a license. <br />252 B.Except as may otherwise be provided by law, the existence of any particular ground for <br />253 denial does not compel the city to deny the license. <br />254 C.If a license is mistakenly issued or renewed to a person, it will be revoked upon the <br />255 discoverythat the person was ineligible for the license under this ordinance. The city <br />256 will provide thelicense holder with notice of the revocation, along with information <br />257 on the rightto appeal. <br />258 306.06PROHIBITEDSALES: <br />259A.In general. No person shall sell or offer to sell any Licensed Product: <br />2601.By meansof a vending machine. (Ord. 1555,6-18-2018) <br />261 <br />2622.By means of loosies as defined. <br />263 <br />264 Containing opium, morphine, jimson weed, bella donna, strychnos, cocaine, <br />3. <br />265 marijuana, or other deleterious, hallucinogenic, toxic, or controlled <br />266 substances except nicotine and other substances found naturally in tobacco or <br />267 added as part of an otherwise lawful manufacturing process. It is not the <br />268 intention of this provision to ban the sale of lawfully manufactured cigarettes <br />269 or other products subject to this ordinance. <br />270 <br />271 4. By self-service merchandizing whereby the customer may have access to those <br />272 products without having to request the products from the licensee or licensee’s <br />273 employee and whereby there is not a physical exchange of the licensed <br />274 product between the licensee or licensee’s employee and the customer. All <br />275 Licensed Products must be stored behind the sales counter or other area not <br />276 freely accessible to customers, or in a case or other storage unit not left open <br />277 and accessible to the general public. Legal age. No person shall sell any Licensed Productto any person under the age of 21. <br />282 <br />283 1.Age verification. Licensees must verify by means of government-issued <br />284 photographic identification containing the bearer’s date of birth that the <br />285 purchaser is at least 21 years of age. Verification is not required for a person <br />286 over the age of 30. That the person appeared to be 30 years of age or older <br />287 does not constitute a defense to a violation of this subsection. <br />288 <br />289 2.Signage. Notice of the legal sales age, age verification requirement, and <br />290 possible penalties for underage sales must be posted prominently and in plain <br />291 view at all times at each location where Licensed Products are offered for <br /> <br />
