Flavored products. No person shall sell or offer for sale any flavored products,except 297 Age-Restricted Tobacco Retailers. 298 299 D. Liquid packaging. No person shall sell or offer to sell any liquid, whether or not such 300 liquid contains nicotine, which is intended for human consumption and use in an electronic 301 delivery device, in packaging that is not child-resistant. Upon request by the city, a licensee 302 must provide a copy of the certificate of compliance or full laboratory testing report for the 303 packaging used. 304 305 306.07RESPONSIBILITY: 306 307 All licensees are responsible for the actions of their employees in regard to the sale, offer to 308 sell, and furnishing of Licensed Products on the licensed premises. The sale, offer to sell, or 309 furnishing of any Licensed Product by an employee shall be considered an act of the licensee. 310 Nothing in this section shall be construed as prohibiting the city from also subjecting the 311 employee to any civil penalties that the city deems to be appropriate under this ordinance, 312 state or federal law, or other applicable law or regulation. 313 314 306.08COMPLIANCE CHECKS: 315 316 All licensed premises shall be open to inspection by Roseville law enforcement or other 317 authorized City officials during regular business hours. From time to time, but at least twice 318 per year, the City shall conduct compliance checks. In accordance with state law, the city will 319 conduct compliance checks that involve the participationof a person at least 17 years of age, 320 but under the age of 21 to enter the licensed premises to attempt to purchase Licensed 321 Products. Prior written consent from a parent or guardian is required for any person under the 322 age of 18 to participate in a compliance check. Persons used for the purpose of compliance 323 checks will be supervised by law enforcement or other designated personnel.Persons used 324 for the purpose of compliance checks shall be supervised by the Chief of Police, or the Chief 325 of Police’s designee. No person used in compliance checks shall attempt to use a false 326 identification misrepresenting the person’s age and all persons lawfully engaged in a 327 compliance check shall answer all questions about the person’s age, asked by the licensee or 328 licensee’s employee and shall produce any identification, if any exists, for which the person is 329 asked. Nothing in the subdivision shall prohibit compliance checks authorized by State or 330 Federal laws for educational, research, or training purposes, or required for the enforcement 331 of a particular State of Federal law.
