An unusual hardship on the land exists. The dramatic drop in elevation across the site from the 39 <br />southern portion of the subject property toward the north renders the prospect of a street connection 40 <br />to Marion Street cul-de-sac or to S McCarrons Boulevard (or both) infeasible. This obstacle to 41 <br />designing a street to intersect with the surrounding network (and thereby obviating the limit on cul-42 <br />de-sac street length) constitutes an unusual hardship, which the subdivision variance process is 43 <br />intended to relieve. 44 <br />4. The variance, if granted, will not alter the essential character of the locality. If the requested 45 <br />subdivision variance is approved, the approval will not alter the essential character of the locality 46 <br />because all of the five nearest cul-de-sac streets (i.e., Marion Street, Woodbridge Court, Western 47 <br />Avenue, the eastward segment of Wagner Street, and the westward segment of Wagner Street) 48 <br />exceed 500 feet with respective lengths of 850 feet, 550 feet, 675 feet, 660 feet, and 1,150 feet. 49 <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to approve the 50 <br />requested subdivision variance and the proposed ‘The Enclave at McCarrons Lake’ preliminary plat, 51 <br />based on the public record and City Council deliberation, with the following conditions: 52 <br />1. Pursuant to the comments from Roseville’s Fire Department Chief in Attachment D of the RCA 53 <br />reviewed with this application, the applicant shall install a fire hydrant near the end of the proposed 54 <br />cul-de-sac street, as shown on the proposed plans. 55 <br />2. Pursuant to the memo from Public Works staff in Attachment D of the RCA reviewed with this 56 <br />application, the applicant shall: 57 <br />a. Dedicate the easments and additional public right-of-way as specified by the City Engineer. 58 <br />b. Enter into a Public Improvement Contract regarding the construction of public infrastructure. 59 <br />c. Establish a homeowner’s association for the maintenance of the private street, utilities, and storm 60 <br />water management BMPs. 61 <br />3. In accordance with the recommendation of the Parks and Recreation Commission, the applicant shall 62 <br />dedicate cash in lieu of park land in the amount of $72,250 prior to filing the plat at Ramsey County 63 <br />with the caveat that the Marion Street Greenway trail connection also be included as part of the 64 <br />Public Improvement Contract. 65 <br />4. The developer shall increase the number of trees planted between Lot 1 and Galtier Street thereby 66 <br />improving the screening in that location and partially recreating the current natural conditions in that 67 <br />location. The number and location shall be maximized to the extent practical, while ensuring 68 <br />survivability, based upon recommendations of the City’s consulting forester. 69 <br />WHEREUPON said resolution was declared duly passed and adopted. 70 <br />RCA Attachment F <br />Page 4 of 8
