A homeowners association (HOA) must govern the use and maintenance of the shared access. <br />168 Each of these additional requirements is fairly clear and, as these are standards established in the zoning <br />169 code, they do not need to be specified as conditions of approval of the controlled accessesas a <br />170 conditional use. <br />171 P UBLIC C OMMENT <br />172 As required for plats creating more than three lots, the applicant conducted a pre-application community <br />173 engagement effort and held a virtual open house in late January 2021. The applicant has submitted a <br />174 detailed summary of the discussion that occurred during the virtual open house meeting, which is <br />175 included with this RCA as part of Attachment D, along with the minutes of the April 7, 2021, Planning <br />176 Commission public hearing, and emails received from members of the public before the City Council <br />177 required the developer to complete the EAW. The EAW process produced extensive public comment, <br />178 with eight public agencies and 31 residents providing feedback on the proposed development. No <br />179 additional public comment about the proposed development has been received since the conclusion of <br />180 the EAW review process. <br />181 P OLICY O BJECTIVE <br />182 <br />183 and retains a diverse mix of people, family types, economic statuses,ages,and so on. <br />184 B UDGET I MPLICATIONS <br />185 Receipt of $25,500 fee in lieu of park land dedication. Refer to DRC comments in Attachment E. <br />186 S TAFF R ECOMMENDATION <br />187 A. Adopt a resolution approving the proposed ‘Victoria Shores’ preliminary plat based on the <br />188 content of this RCA, public input, the recommendation and findings of the Planning Commission, <br />189 and City Council deliberation, with the following conditions. <br />190 1. Pursuant to the memo from Public Works staff in Attachment E of this RCA, the applicant shall: <br />191 a. Dedicate the additional public right-of-way as required for Orchard Lane and Victoria Street. <br />192 b. Dedicate a 10-foot pathway easement coinciding with the drainage and utility easement <br />193 behind the property line of the lots abutting the west side of Victoria Street to accommodate a <br />194 possible future public pathway in this location. <br />195 c. Enter into a Public Improvement Contract regarding the construction of public infrastructure. <br />196 d. Establish a homeowner’s association for the maintenance of the storm water management <br />197 BMPs. <br />198 e. Install wetland buffer signs on the property lines where the wetland buffer intersects. <br />199 2.
