Attachment A
REQUEST FOR PLANNINGCOMMISSION ACTION
Agenda Date:02/02/22
Agenda Item: 6a
Prepared ByAgenda Section
Public Hearing
Item Description: Consideration of a request by Launch Properties for preliminary approval of a
th
Major Plat to subdivide 8.01 acres to be known as Twin Lakes 4 Addition into
five commercial lots for future development (PF21-020).
1 A PPLICATION I NFORMATION
2 Applicant: Launch Properties
3 Location: Twin Lakes Station redevelopment area - PID
4 042923430020 – area adjacent to County RD C
5 Property Owner:Roseville Investment Partners LLC
6 Community Engagement: 01/11/22 developer open house, including virtual
7 meeting component
8 Application Submission: 11/04/21; deemed complete January 13, 2022
9 City Action Deadline:120 days – May 13, 2022
10 L EVEL OF D ISCRETION IN D ECISION M AKING:quasi-judicial.
11 P ROPOSAL S UMMARY
12 The applicant proposes to subdivide the existing outlot into five lotsto facilitate commercial
13 development. The existing parcel, legally described as Outlot A, Twin Lakes Third Addition, was
14 created through a Minor Plat as a component of the Dominium residential development of The Oasis
15 and The Harbor. The goalat that timewas to reserve a portion of the site for future commercial
16 development. The property is zoned Community Mixed Use (MU-2B), which does not have any
17 specific lot minimum standards, however does include an established Regulating Plan and Map to
18 guide future development on the subject property. The preliminary plat and other plans regarding the
19 proposed development are included with this RPCA in Attachment C.
20 When exercising the “quasi-judicial” authority on subdivision requests, the role of the City is to
21 determine the facts associated with a particular proposal and apply those facts to the legal standards
22 contained in the ordinance and relevant state law. In general, if the facts indicate the application meets
23 the relevant legal standards and will not compromise the public health, safety, and general welfare,
24 then the applicant is likely entitled to the approval. The City is, however, able to add conditions to a
25 subdivision approval to ensure that potential impacts to parks, schools, roads, storm sewers, and other
26 public infrastructure on and around the subject property are adequately addressed. Subdivisions may
27 also be modified to promote the public health, safety, and general welfare, as well as to provide for the
28 orderly, economic, and safe development of land. Finally, conditions to a subdivision can be used to
29 promote housing affordability for all levels.
PF21-020_TLS_MajorPlat_RPCA_020222
