RCA Attachment E <br />1 <br />2 PUBLIC IMPROVEMENT CONTRACT <br />3 VICTORIA SHORES <br />4 <br />5 <br />6 I. Parties. This Agreement, dated ____________________, 2022, is entered into between the City of <br />7 Roseville, a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, <br />8 Minnesota 55113 (the Ð City Ñ), and Builders Lot Group, LLC, a Minnesota limited liability <br />th <br />9 company, whose address is 9531 West 78 Street #135, Eden Prairie, MN 55344 (the Ð Developer Ñ). <br />10 II. Request for Plat approval. The Developer has asked the City to approve a plat of land to be known <br />11 as Ð Victoria Shores Ñ (also referred to in this Agreement as the ÐPlatÑ). The land is legally described <br />12 as follows: <br />13 See Legal Description attached as Exhibit A hereto (the ÐPropertyÑ). <br />14 <br />15 III.Terms and Conditions of Plat Approval. For good and valuable consideration, the receipt and <br />16 sufficiency of which are hereby acknowledged, the parties agree as follows: <br />17 A. Plat Approval: Subject to the terms and conditions of this Public Improvement Contract, the <br />18 recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />19 of the Plat. <br />20 B. Land Use: Construction and operation of nine single family lots with one common area outlot (10 <br />21 lots total). <br />22 C. Public Improvements. The Developer shall, subject to the terms and conditions contained herein, <br />23 perform the following work and construct the following improvements (ÐPublic ImprovementsÑ) in <br />24 compliance with City approved Public Improvement Construction Plans described in Section III E <br />25 below and all rules, regulations, standards and ordinances of the City: <br />26 <br />27 Trail construction: The Developer shall construct an 8-foot bituminous pathway along <br />28 the easterly right-of-way of Victoria Street (CSAH NO. 52) for the length of the plat <br />29 (approximately 968.0 L.F.). <br />30 The pathway shall be constructed in accordance with City details, specifications, and the <br />31 City approved Public Improvement Construction Plans. <br />32 Erosion control: Prior to the commencement of any grading and before any utility <br />33 construction is commenced or building permits are issued, the erosion control plan must <br />34 be implemented, inspected and approved by the City. The Developer shall meet all <br />35 requirements of the CityÓs Erosion Control Ordinance including but not limited to the <br />36 following: <br />37 No construction activity shall be allowed and no building permits shall be issued unless <br />38 the Property is in full compliance with the erosion control requirements. <br />39 Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />Page 1 of 14 <br /> <br />Page 1 of 14 <br /> <br />
