<br />1 Preliminary Plat Approval <br />rd <br />2 The Midland Legacy Estate 3 Addition plat consists of a subdivision creating nine lots for single- <br />3 family, detached homes with an outlot for future platting into up to three additional lots for single-family <br />4 detached homes, and park dedication of approximately 0.8 acres. The developer proposes to realign the <br />5 intersection of County Road B and Eustis Street into a conventional “T” shaped intersection and build a <br />6 private cul-de-sac street serving Lot 1, Lot 9, and the future lots platted in Outlot A, as well as providing <br />7 access to a shared driveway serving Lots 2-4, departing from the eastern end of the cul-de-sac. On <br />8 August 23, 2021, the City Council reviewed the proposal along with the public record and adopted <br />rd <br />9 Resolution 11826approving the proposed preliminary Midland Legacy Estate 3Additionplat, with the <br />10 following conditions. <br />11 1. Pursuant to the memo from Public Works staff reviewed with this proposal, the applicant shall: <br />12 a. Install pathway improvements as shown on the proposed plans, on the west and south side of the <br />13 development, to make connections to the existing pathway on County Road B. <br />14 b. Submit additional storm water management information to meet pertinent requirements for staff <br />15 review. <br />16 c. Enter into a Public Improvement Contract regarding the construction of public infrastructure. <br />17 2. The applicant shall establish a homeowner’s association for the maintenance of the private street, <br />18 shared driveway, and storm water management BMPs. <br />19 3. In addition to the dedication of 10% of the development site (i.e., 0.616 acres) of park land, and in <br />20 accordance with the recommendation of the Parks and Recreation Commission, the applicant shall <br />21 continue negotiations with the City regarding the transfer of the additional quarter-acre of land to <br />22 increase the area of the park lot to approximately 0.875 acres as illustrated in the “preferred plan” <br />23 reviewed with this proposal. The final plat submitted by the applicant shall include the mandatory <br />24 0.616 acres of dedicated park land, which dedication will obviate further park dedication at such <br />25 time as Outlot A may be further platted into additional residential lots, as well as any additional park <br />26 land specified in the negotiation. <br />27 4. The applicant shall continue to address with Fire Department staff any issues regarding the <br />28 characteristics of the shared driveway, water supply at the end of the shared driveway, and/or <br />29 installation of sprinklers within one or more of the homes to satisfy applicable fire code <br />30 requirements. <br />31 5. The applicant shall reconfigure Lots 1-4 (and the location of the shared driveway easement, if <br />32 necessary) such that the land area northeast of the shared driveway is allocated to Lot 1 and not <br />33 divided among the lots on the opposite side of the shared drivway. <br />34 6. The applicant shall install landscaping and/or fencing along the eastern boundary of Lots labeled L1 <br />35 and L4, as approved by the Community Development Department, to achieve six feet of screening <br />36 height for adjacent properties from headlights of vehiclesfacing eastward on the shared driveway. <br />37 7.
