41 Final Plat <br />42 The proposed final platis providedwith this RCA as Attachment Cand is consistent with the <br />43 preliminary plat approval as: <br />44 In the time since the preliminary plat approval, the storm water management plan has received <br />45 preliminary approval from the watershed district, which satisfies the related concern identified <br />46 in Condition 1. <br />47 The plat includes a 0.8 acre park lot consisting of about 0.6 acres of dedicated park land in <br />48 addition to about 0.2acresof land to be purchased by the Cityto satisfy Condition 3 of the <br />49 approval. Parks and Recreation Department staff have been working with the City Attorney and <br />50 the applicant to finalize the purchase agreement; it is included with a draft resolution approving <br />51 the purchase as Attachment F. <br />52 The plat reflects revised boundaries to satisfy Condition 5 of the approval. <br />53 The former house has been removed from the property, thereby satisfying Condition 7 of the <br />54 approval. <br />55 Minnesota Statute 462.356 establishes how a City is to realize the goals of its Comprehensive Plan once <br />56 adopted, and in practice requires the Roseville’s Planning Commission to review all proposals by the <br />57 City to acquire or dispose of land and to make findings as to the compliance of the acquisition and/or <br />58 disposal with the Comprehensive Plan. The dedication and purchase of park land in the Midland Legacy <br />rd <br />59 Estate 3 Addition plat represents such an acquisition. Roseville’s Planning Commission satisfied its <br />60 statutory obligation by reviewing the proposed preliminary plat at a public hearing on August 4, 2021, <br />61 with findings supporting the acquisitions of park land, and reporting its findings to the City Council on <br />62 August 23, 2021, with its recommendation to approve the development proposal. <br />63 On February 28, 2022, the City Council held a public hearing regarding the requested vacation ofthe <br />64 abutting portion of County Road B right-of-way to facilitate a reconstruction of its intersection with <br />65 Eustis Street as discussed prior to approving the preliminary plat. The proposed final plat is consistent <br />66 withthe City Council’s action to vacate this portion of County Road B right-of-way. <br />67 Public Improvement Contract <br />68 As part of the approval process and before the final plat can be executed, the developer is required to <br />69 enter into a public improvement contract (PIC) for the public improvements required to be constructed <br />70 as part of the project. The public improvements include re-alignment of County Road B and Eustis <br />71 Street, installation of a pathway adjacent to the development on County Road B and Eustis Street, <br />72 installation of new storm sewer, and installation of new water and sewer mains. The PIC has been <br />73 reviewed by the City Attorney is included with this RCA as Attachment G. The details of public <br />74 improvements and development specified in the PIC are shown in the plans included as Attachment H. <br />75 All work would be done through the developer’s contractor. All costs for the improvements would be <br />76 paid by the developer. The estimated cost of construction of the public infrastructure is $379,500. The <br />77 developer will provide a financial security in the amount of 125% of the estimated cost of construction, <br />78 $474,375, in the event the developer fails to perform. The City will oversee the construction.
