This Agreement, dated ____________________, 2022, is entered into between the City of <br />13 Roseville, a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, <br />14 Minnesota 55113 (the Ð City Ñ), and Integrity Land Development, Inc., a Minnesota corporation, <br />15 whose address is 13635 Johnson Street NE, Andover, MN 55304 (the Ð Developer Ñ). <br />16 II. Request for Plat approval. The Developer has asked the City to approve a plat of land to be known <br />rd <br />17 as Ð Midland Legacy Estate 3 Addition Ñ (also referred to in this Agreement as the ÐPlatÑ). The <br />18 land is legally described as follows: <br />19 See Legal Description attached as Exhibit A hereto (the ÐPropertyÑ). <br />20 <br />21 III. Terms and Conditions of Plat Approval. For good and valuable consideration, the receipt and <br />22 sufficiency of which are hereby acknowledged, the parties agree as follows: <br />23 A. Plat Approval: Subject to the terms and conditions of this Public Improvement Contract, the <br />24 recitals above, and all other applicable City Code provisions, the City hereby approves the recording <br />25 of the Plat. <br />26 B. Land Use: Construction and operation of nine single family homes, one outlot which could become <br />27 three additional single family homes, one common area outlot including a private road. Additionally, <br />28 one lot will be dedicated to the City for use as a public park. <br />29 C. Public Improvements. The Developer shall, subject to the terms and conditions contained herein, <br />30 perform the following work and construct the following improvements (ÐPublic ImprovementsÑ) in <br />31 compliance with City approved Public Improvement Construction Plans described in Section III E <br />32 below and all rules, regulations, standards and ordinances of the City: <br />33 <br />34 1. Restoration of existing streets: Curb cuts and street cuts shall be reconstructed to match <br />35 existing street typical section. <br />36 a) All unused curb openings along Eustis Street and County Road B curb line shall be <br />37 removed and replaced with non-surmountable curb to match existing. Curbs proposed to <br />38 be replaced shall have a minimum of 3 feet of bituminous saw cut out to allow for proper <br />39 compaction. <br />40 b) County Road B and Eustis Street shall be relocated per the Plans. <br />41 (1) County Road B and Eustis Street will remain public roadways. <br />Page 1 of 17 <br /> <br />Page 1 of 18 <br /> <br />
