REQUEST FOR COUNCIL ACTION <br />Date: April 11, 2022 <br />Item No.: 10.h <br />Department Approval City Manager Approval <br />Item Description: Authorize Staff to begin Vacation Process for Various Rights-Of-Way within <br />the City of Roseville <br />1 B ACKGROUND <br />2 In the past, the City has vacated numerous City rights-of-way for various reasons. Some have been <br />3 City-led vacations while others have been petitioner-led. Over the past couple of years, staff has <br />4 been accumulating a list of rights-of-way thatthe City no longer needs for a variety of reasons. <br />5 Some of these rights-of-way were dedicated to the City for future roadways that were never <br />6 constructed. Some were partial right-of-way dedications while others were alley dedications. In all <br />7 the cases, the City has no plans to construct a future roadway. Some of the corridors have utilities or <br />8 trails within the right-of-way but some sort of easement, which would be more appropriate if a <br />9 roadway will not be constructed, would be maintained if the right-of-way was vacated. <br />10 By vacating these rights-of-way, the City will be able to provide the proper maintenance of the <br />11 corridors and adjacent property owners, in most cases, will have the benefit of having more control <br />12 of the former right-of-way. This also helps with confusion and disagreements over how the right-of- <br />13 way area should be maintained in regards to vegetation control and debris management. <br />14 Attachment A shows the locations of the 29 proposed right-of-way locations within the City. <br />15 Attachment B is amore detailed exhibit of the specific rights-of-way proposed to be vacated. <br />16 If Council authorizes staff to begin the vacation process for these locations, staff would first notify <br />17 adjacent property owners of the City’s intent, collect initial input and any concerns, and then set a <br />18 public hearing for each of the right-of-way vacations staff feels should be completed after the initial <br />19 input. The hearings would occur later this summer over a few meetings. Since these would all be <br />20 City-initiated vacations, a four-fifths vote would be required at that time to complete the vacation of <br />21 any of these rights-of-way. <br />22 F INANCIAL I MPACTS <br />23 Aside from costs related to filing the vacations with Ramsey County and the mailings to notify the <br />24 residents, there are no direct costs to the City of Roseville to vacate right-of-way corridors. <br />25 S TAFF R ECOMMENDATION <br />26 Authorize staff to begin the vacation process for various rights-of-way within the City of Roseville. <br />Page 1 of 2 <br /> <br />
