<br />VILLAGE COUNCIL OF ROSEVILLE <br />Regular meeting Tuesday, February 2, 1954, at 2:00 P.M. <br /> <br />The Village Council met on the above date with the following members <br />present:: Olson, Carlson, Willmus, Salverda, Hammersten, Milner <br />Carley, Village Engineer was also present. <br /> <br />Olson moved, Carlson seconded that the minutes of the last meeting <br />be approved as they appeared on the copies furnished the members. <br />Roll Call Ayes-(5) Nayes-CO). <br /> <br />Clerk read petition to rezone Zittel & Maher property, from farm <br />residence to business district and the report of aoning board <br />?lhich recommended it be denied. )Ir. Wm. Schroder-2103 Rice St. <br />opposed the rezoning due to the fact that they want to put up a <br />shopping center, saying it would effect the surrounding property. <br /> <br />Hammersten moved, Olson seconded that the application be denied. <br />Roll Call Ayes-CO) Nayes-Cp). <br /> <br />Clerk read resolution presented by Mr. Van Krevlin of the Minnesota <br />Highway Department for final approval of trunk highway grading <br />from Como Avenue into Roseville. <br /> <br />Hammersten moved, Carlson seconded that the resolution be adopted. <br />Roll Call Ayes~(5) Nayes-(O). <br /> <br />Mr. Douglas, Attorney-representing property owners near the trailer <br />camp, made an appeal to the council that they appeal the case to the <br />supreme court. He gave three possible P9ints that may change the <br />case. First, zoning ordinance in 1942, 1948, and 1953. That <br />entire area was used as a tnailer park. Make the council render <br />that fact and hold them to it. <br /> <br />The court made a finding that Mr. Howard's expansion did not constitute <br />a violation of any ordinance. The second is t hat whether or not that <br />entire area was being used in 1941 as a trailer park. Third, any <br />abandonment of the use of the property made prior to 1941. Karon <br />found the evidence overwhelmingly decreased in size in 1946. I <br />believe there were 5 or 6 witnesses. If explained on that point, <br />it may help. Abandonment of the use of the preperty would have to <br />be considered. <br /> <br />An appeal should be taken for the Village as a whole. <br /> <br />An appeal must be taken before the 11th of February, otherwise there <br />would be no appeal possible by virtue of the expirement of the 40 <br />days allowed. <br /> <br />Ray Slomkowski-809 Lovell, Grandview Parks Organization, with a <br />membership of 100, spoke on how the taxes and fire protection will go <br />up, cost of educating children from additional trailers. <br /> <br />Don Johnson, 771 Cope, spoke and suggested that the Village pay for <br />the appealing of the case. <br /> <br />The attorney spoke on the ~oning validity of zoning ordinance. <br /> <br />445 <br /> <br />Zittel & <br />Maher re- <br />zoning <br /> <br />Trunk Highway <br />Grading <br />
