2 <br />1 WHEREAS, after two weeks published and posted notice have been given as well as notice <br />2 having been mailed to all affected property owners according to Minnesota Statutes, a public <br />th <br />3 hearing was held on 6 day of June, 2022 at which all persons interested in said vacation were <br />4 given an opportunity to be heard; and <br />5 <br />6 WHEREAS, the Roseville City Council has determined that the vacation would be in the public <br />7 interest. <br />8 <br />9 NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />10 ROSEVILLE, MINNESOTA: <br />11 <br />12 1. That the City of Roseville hereby vacates the easement for utility purposes, which lies within <br />13 the following described real property: <br />14 <br />15 A 20 FOOT EASEMENT THE CENTER LINE DESCRIBED AS FOLLOWS: <br />16 COMMENCING AT A POINT ON THE WEST LOT LINE OF LOT 1, BLOCK <br />17 2, RICHARDS PARK 406 FEET SOUTHWESTERLY OF THE NORTHWEST <br />18 CORNER OF SAID LOT 1; THENCE SOUTHEASTERLY 324 FEET MORE <br />19 OR LESS TO A POINT 52 FEET SOUTH AND 335 FEET EAST OF THE <br />20 SOUTHWEST CORNER OF SAID LOT 1 AND THERE TERMINATING, <br />21 According to the plat thereof on file or of record in the office of the Register of <br />22 Deeds in and for said County and State. <br />23 <br />24 2. The vacation applies only to the portions of the Easements located within the Property and <br />25 not to: (a) the rights of existing utilities, if any, and (b) any other easements running to or <br />26 benefiting the City of Roseville, if any. <br />27 <br />28 3. Contingent upon the establishment of new easements on the Property, dedicated to the City <br />29 of Roseville on the final plat, the City Manager is directed to execute and record a Notice of <br />30 Completion of this vacation proceeding pursuant to Minnesota Statutes § 412.851. The <br />31 vacation authorized by this Resolution shall not be effective until the Notice of Completion is <br />32 recorded in the office of the Ramsey County Recorder. <br />33 <br />34 The motion was duly seconded by Councilmember and upon vote being taken thereon, the <br />35 following voted in favor thereof: ; and and thefollowing voted against: <br />36 <br />37 WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />
