32 Given it may be difficult for certain owners to understand if their rents are affordable, as <br />33 defined in the ordinance, the Notice to the City of Proposed Salerequirement (910.03) could <br />34 be applied to every licensed rental property instead of only those that charge rents at or below <br />35 80% AMI. A suggestion was also offered to collect this information as part of the licensing <br />36 process to alleviate confusion if/when the owner initiates a sale and triggers the Notice to the <br />37 City of Proposed Sale requirement. <br />38 Request to amend the ordinance to allow new owners to perform certain lead and asbestos <br />39 construction activities during the three-month tenant notification period if certain best <br />40 management practices are followed. <br />41 Request to define “rent”, clarifying it doesn’t include utilities, garage space, etc. <br />42 Based on the feedback outlined above, staff has revised the ordinance to provide an exception to the <br />43 prohibition of performing lead and asbestos construction activity during the three month tenant <br />44 notification period if certain conditions are met. Staff has also provided a definition of rent. Staff <br />45 seeks direction from the City Council on whether to retain the Notice to the City of Proposed Sale <br />46 requirement outlined in proposed Section 910.03. Removing it entirely, as suggested bythe <br />47 owner/manager stakeholders, does not provide additional protections that could allow the City to work <br />48 on retaining affordability during an ownership transition. Applying it to every property may remove <br />49 the confusion that could occur in determining whether or not rents are affordable, and therefore subject <br />50 to the Notice to the City of Proposed Sale requirement, but could create additional implementation <br />51 burden to market rate rental units and City staff responsible for implementing the ordinance.City staff <br />52 does not have a recommendation and looks to the Council for direction. <br />53 The next step is ordinance adoption, which would be scheduled for a future City Council meeting. <br />54 The proposed ordinance (Attachment C) was posted on the City’s website on October 10, 2022, which <br />55 will allow the earliest City Council consideration date to be October 24, 2022. <br />56 P OLICY O BJECTIVE <br />57 If adopted, the proposed objective is to provide housing stability, protection, and notification to tenants <br />58 of rental housing during an ownership transition. <br />59 B UDGET I MPLICATIONS <br />60 Actual implementation of the proposed ordinance consists solely of staff time. The engagement <br />61 process that took place from mid-August through September cost approximately $4,000 (not including <br />62 staff time). <br />63 S TAFF R ECOMMENDATION <br />64 Provide staff direction on whether to retain and/or revise the Notice to the City of Proposed Sale <br />65 requirement. Staff would also seek direction on whether additional ordinance revisions are necessary <br />66 and if a meeting for ordinance adoption should be scheduled for October 24, 2022. <br />67 R EQUESTED C OUNCIL A CTION <br />68 By motion, provide staff direction on the following: <br />69 1. Whether to retain and/or revise the Notice to the City of Proposed Sale requirement, <br />70 2. Whether any additional ordinance revisions are necessary, and <br />71 3.
