MnDOTContractNo.1052120 <br />writtenconsentwillinnowayrelievetheLocalGovernmentfromitsprimaryresponsibilityfor <br />performanceofthework. <br />2.2.2. DuringtheprogressoftheworkontheProject(s),theLocalGovernmentauthorizesitsProject <br />Engineertorequestinwritingspecificengineeringand/ortechnicalservicesfromMnDOT,pursuantto <br />MinnesotaStatutesSection161.39.Suchservicesmaybecoveredbyothertechnicalservice <br />agreements.IfMnDOTfurnishestheservicesrequested,andifMnDOTrequestsreimbursement,then <br />theLocalGovernmentwillpromptlypayMnDOTtoreimbursethestatetrunkhighwayfundforthefull <br />costandexpenseoffurnishingsuchservices.ThecostsandexpenseswillincludethecurrentMnDOT <br />laboradditivesandoverheadrates,subjecttoadjustmentbasedonactualdirectcoststhathavebeen <br />verifiedbyaudit.ProvisionofsuchserviceswillnotbedeemedtomakeMnDOTaprincipalorco <br />principalwithrespecttotheProject(s). <br />2.3. Preletting.TheLocalGovernmentwillprepareconstructioncontractsinaccordancewithMinnesotalaw <br />andapplicableFederallawsandregulations. <br />2.3.1. TheLocalGovernmentwillsolicitbidsafterobtainingwrittennotificationfromMnDOTthattheFHWA <br />hasauthorizedtheProject(s).AnyProject(s)advertisedpriortoauthorization withoutpermission will <br />notbeeligibleforfederalreimbursement. <br />2.3.2. TheLocalGovernmentwillpreparetheProposalforHighwayConstructionfortheconstruction <br />contract,whichwillincludeallfederalaidprovisionssuppliedbyMnDOT. <br />2.3.3. TheLocalGovernmentwillprepareandpublishthebidsolicitationfortheProject(s)asrequiredby <br />stateandfederallaws.Th <br />eLocalGovernmentwillincludeinthesolicitationtherequiredlanguagefor <br />federalaidconstructioncontractsassuppliedbyMnDOT.Thesolicitationwillstatewherethe <br />proposals,plans,andspecificationsareavailablefortheinspectionofprospectivebiddersandwhere <br />ds. <br />theLocalGovernmentwillreceivethesealedbi <br />2.3.4. TheLocalGovernmentmaynotincludeotherworkintheconstructioncontractfortheauthorized <br />Project(s)withoutobtainingpriornotificationfromMnDOTthatsuchworkisallowedbyFHWA. <br />Failuretoobtainsuchnotificationmayresultinthelossofsomeorallofthefederalfundsforthe <br />Project(s).Allworkincludedinafederalcontractissubjecttothesamefederalrequirementsasthe <br />federalproject. <br />2.3.5. TheLocalGovernmentwillprepareandselltheplanandproposalpackagesandprepareand <br />distributeanyaddenda,ifneeded. <br />2.3.6. TheLocalGovernmentwillreceiveandopenbids. <br />2.3.7. Afterthebidsareopened,theLocalGovernmentwillconsiderthebidsandwillawardthebidtothe <br />lowestresponsiblebidderorrejectallbids.Iftheconstructioncontractcontainsagoalfor <br />DisadvantagedBusinessEnterprises(DBEs),theLocalGovernmentwillnotawardthebiduntilithas <br />receivedcertificationoftheDisadvantagedBusinessEnterpriseparticipationfromtheMnDOTOffice <br />ofCivilRights. <br />2.3.8. TheLocalGovernmentmustdiscloseinwritinganypotentialconflictofinteresttotheFederal <br />awardingagencyorMnDOTinaccordancewithapplicableFHWApolicy. <br />2.4. ContractAdministration. <br />2.4.1. TheLocalGovernmentwillprepareandexecuteaconstructioncontractwiththelowestresponsible <br />bidder,hereinafterreferredtoastheͻ/ƚƓƷƩğĭƷƚƩͲͼinaccordancewiththespecialprovisionsandthe <br />latesteditionofaƓ5h͸ƭStandardSpecificationsforConstructionwhenthecontractisawardedand <br />allamendmentsthereto.AllcontractsbetweentheLocalGovernmentandthirdpartiesor <br />subcontractorsmustcontainallapplicableprovisionsofthisAgreement,includingtheapplicable <br />2 <br /> <br />
