DiscriminationProhibitedbyMinnesotaStatutes§181.59.TheLocalGovernmentwillcomplywiththeprovisions <br />ofMinnesotaStatutes§181.59whichrequiresthateverycontractfororonbehalfoftheStateofMinnesota,or <br />anycounty,city,town,township,school,schooldistrictoranyotherdistrictinthestate,formaterials,suppliesor <br />constructionwillcontainprovisionsbywhichContractoragrees:1)That,inthehiringofcommonorskilledlabor <br />fortheperformanceofanyworkunderanycontract,oranysubcontract,noContractor,materialsupplieror <br />vendor,will,byreasonofrace,creedorcolor,discriminateagainstthepersonorpersonswhoarecitizensofthe <br />UnitedStatesorresidentalienswhoarequalifiedandavailabletoperformtheworktowhichtheemployment <br />relates;2)ThatnoContractor,materialsupplier,orvendor,will,inanymanner,discriminateagainst,or <br />intimidate,orpreventtheemploymentofanypersonorpersonsidentifiedinclause1ofthissection,oronbeing <br />hired,preventorconspiretoprevent,thepersonorpersonsfromtheperformanceofworkunderanycontracton <br />accountofrace,creedorcolor;3)Thataviolationofthissectionisamisdemeanor;and4)Thatthiscontractmay <br />becanceledorterminatedbythestateofMinnesota,oranycounty,city,town,township,school,schooldistrictor <br />anyotherpersonauthorizedtocontractsforemployment,andallmoneydue,ortobecomedueunderthe <br />contract,maybeforfeitedforasecondoranysubsequentviolationofthetermsorconditionsofthisAgreement. <br />18. FederalContractClauses <br />18.1. AppendixII2CFRPart200.TheLocalGovernmentagreestocomplywiththefollowingfederal <br />requirementsasidentifiedin2CFR200,UniformAdministrativeRequirements,CostPrinciplesandAudit <br />RequirementsforFederalAwards,andagreestopassthroughtheserequirementstoitssubcontractorsand <br />thirdpartycontractors,asapplicable.Inaddition,theLocalGovernmentshallhavethesamemeaningas <br />ͻ/ƚƓƷƩğĭƷƚƩͼinthefederalrequirementslistedbelow. <br />18.1.1. Contractsformorethanthesimplifiedacquisitionthreshold,whichistheinflationadjustedamount <br />determinedbytheCivilianAgencyAcquisitionCouncilandtheDefenseAcquisitionRegulations <br />Council(Councils)asauthorizedby41U.S.C.1908,mustaddressadministrative,contractual,orlegal <br />remediesininstanceswherecontractorsviolateorbreachcontractterms,andprovideforsuch <br />sanctionsandpenaltiesasappropriate. <br />18.1.2.
