MnDOTContractNo.1052120 <br />forcompliancewiththeCopelandͻ!ƓƷźYźĭƉĬğĭƉͼAct(40U.S.C.3145),assupplemented <br />byDepartmentofLaborregulations(29CFRPart3,ͻ/ƚƓƷƩğĭƷƚƩƭandSubcontractorsonPublic <br />BuildingorPublicWorkFinancedinWholeorinPartbyLoansorGrantsfromtheUnited{ƷğƷĻƭͼΜ͵ <br />TheActprovidesthateachcontractororsubrecipientmustbeprohibitedfrominducing,byany <br />means,anypersonemployedintheconstruction,completion,orrepairofpublicwork,togiveup <br />anypartofthecompensationtowhichheorsheisotherwiseentitled.ThenonFederalentitymust <br />reportallsuspectedorreportedviolationstotheFederalawardingagency. <br />18.1.5. ContractWorkHoursandSafetyStandardsAct(40U.S.C.37013708).Whereapplicable,all <br />contractsawardedbythenonFederalentityinexcessof$100,000thatinvolvetheemploymentof <br />mechanicsorlaborersmustincludeaprovisionforcompliancewith40U.S.C.3702and3704,as <br />supplementedbyDepartmentofLaborregulations(29CFRPart5).Under40U.S.C.3702oftheAct, <br />eachcontractormustberequiredtocomputethewagesofeverymechanicandlaboreronthebasis <br />ofastandardworkweekof40hours.Workinexcessofthestandardworkweekispermissible <br />providedthattheworkeriscompensatedatarateofnotlessthanoneandahalftimesthebasic <br />rateofpayforallhoursworkedinexcessof40hoursintheworkweek.Therequirementsof40 <br />U.S.C.3704areapplicabletoconstructionworkandprovidethatnolaborerormechanicmustbe <br />requiredtoworkinsurroundingsorunderworkingconditionswhichareunsanitary,hazardousor <br />dangerous.Theserequirementsdonotapplytothepurchasesofsuppliesormaterialsorarticles <br />ordinarilyavailableontheopenmarket,orcontractsfortransportationortransmissionof <br />intelligence. <br />18.1.6. CleanAirAct(42U.S.C.74017671q.)andtheFederalWaterPollutionControlAct(33U.S.C.1251 <br />1387),asamendedContractsandsubgrantsofamountsinexcessof$150,000mustcontaina <br />provisionthatrequiresthenonFederalawardtoagreetocomplywithallapplicablestandards, <br />ordersorregulationsissuedpursuanttotheCleanAirAct(42U.S.C.74017671q)andtheFederal <br />WaterPollutionControlActasamended(33U.S.C.12511387).Violationsmustbereportedtothe <br />FederalawardingagencyandtheRegionalOfficeoftheEnvironmentalProtectionAgency(EPA). <br />18.1.8. DebarmentandSuspension(ExecutiveOrders12549and12689)Acontractaward(see2CFR <br />180.220)mustnotbemadetopartieslistedonthegovernmentwideexclusionsintheSystemfor <br />AwardManagement(SAM),inaccordancewiththeOMBguidelinesat2CFR180thatimplement <br />ExecutiveOrders12549(3CFRpart1986Comp.,p.189)and12689(3CFRpart1989Comp.,p.235), <br />ͻ5ĻĬğƩƒĻƓƷand{ǒƭƦĻƓƭźƚƓ͵ͼSAMExclusionscontainsthenamesofpartiesdebarred,suspended, <br />orotherwiseexcludedbyagencies,aswellaspartiesdeclaredineligibleunderstatutoryor <br />regulatoryauthorityotherthanExecutiveOrder12549. <br />18.1.9.
