ContractWorkHoursandSafetyStandardsAct(40U.S.C.37013708).Whereapplicable,all <br />contractsawardedbythenonFederalentityinexcessof$100,000thatinvolvetheemploymentof <br />mechanicsorlaborersmustincludeaprovisionforcompliancewith40U.S.C.3702and3704,as <br />supplementedbyDepartmentofLaborregulations(29CFRPart5).Under40U.S.C.3702oftheAct, <br />eachcontractormustberequiredtocomputethewagesofeverymechanicandlaboreronthebasis <br />ofastandardworkweekof40hours.Workinexcessofthestandardworkweekispermissible <br />providedthattheworkeriscompensatedatarateofnotlessthanoneandahalftimesthebasic <br />rateofpayforallhoursworkedinexcessof40hoursintheworkweek.Therequirementsof40 <br />U.S.C.3704areapplicabletoconstructionworkandprovidethatnolaborerormechanicmustbe <br />requiredtoworkinsurroundingsorunderworkingconditionswhichareunsanitary,hazardousor <br />dangerous.Theserequirementsdonotapplytothepurchasesofsuppliesormaterialsorarticles <br />ordinarilyavailableontheopenmarket,orcontractsfortransportationortransmissionof <br />intelligence. <br />18.1.6.
