Regular City Council Meeting <br /> Monday,November 28, 2022 <br /> Page 14 <br /> Councilmember Willmus asked if those specific conditions have been spelled out <br /> in the Conditional Use respective to height, etc.,noting he missed that if they have. <br /> Mayor Roe thought it has to meet the City Zoning requirements. <br /> Councilmember Willmus noted Councilmember Etten gave some specific stand- <br /> ards that are less than Code and wondered if those are spelled out somewhere. <br /> Councilmember Etten indicated they are in this, but it is not a document that they <br /> must set by,but City Code is fifty-five feet, and the current proposal is 45.6 feet. <br /> Mayor Roe explained that he thought Councilmember Willmus was asking if with <br /> a condition of approving a Conditional Use, could the Council consider adding a <br /> condition that decreases the height limitation from Code requirement based on the <br /> proposal? He would look to the City Attorney, who nodded in the affirmative so <br /> the Council might have that ability. If the Council wished to do that as an amend- <br /> ment to the motion, it could be done. <br /> Councilmember Willmus moved, Etten seconded, an amendment to spell and cod- <br /> ify some of those standards the Council has been discussing as conditions to the <br /> Conditional Use. <br /> Mayor Roe asked City Attorney Gaughan if a way to address this is to say the con- <br /> dition is that the project must conform to the information provided by the proposer <br /> this evening as laid out on the plans. <br /> City Attorney Gaughan explained the Council could certainly condition approval <br /> upon the representations made by the applicant regarding the project. <br /> Councilmember Etten asked if the amendment made is so restrictive now that any <br /> building project gets going there may prevent the project from moving forward. <br /> Councilmember Willmus indicated if there would be a change to the Conditional <br /> Use it would have to come back to the City Council for approval; that is what a <br /> Conditional Use is for. <br /> Mayor Roe explained conceivably the Council could set something higher if the <br /> Council wanted to. <br /> Councilmember Willmus explained the Council is going through, looking at this, <br /> and making some justifications for the Conditional Use, which the Council is not <br /> obligated to provide, and there have certainly been some comments made with re- <br /> spect to design elements, etc. What he is saying is that the Council is inclined to <br /> approve this Conditional Use and the Council should go ahead and codify those in <br />
