Attachment <br />Proposed Shoreland Ordinance Update <br />4962 i. The greater of 20 feet or 20% of contiguous shoreline to a depth of 10 feet shall be <br />4963 restored with trees, shrubs, and low ground covers consisting of native plants which are <br />4964 consistent with the natural cover of the shoreline. <br />4965 ii. A planting plan which is acceptable to City Staff shall be submitted that demonstrates <br />4966 how the restoration will occur. <br />4967 iii. Either a conservation easement for the restored area shall be established and recorded, or <br />4968 signage following City policies shall be installed and maintained around the restoration <br />4969 area. <br />4970 5. Conditional Uses: All conditional uses in the shoreland area are subject to a thorough evaluation <br />4971 of the waterbody and the topographic, vegetation, and soil conditions to ensure: <br />4972 a. The prevention of soil erosion or other possible pollution of public waters, both during and <br />4973 after construction; <br />4974 b. The visibility of structures and other facilities as viewed from public waters is limited; <br />4975 c. There is adequate water supply and on-site sewage treatment; and <br />4976 d. The types, uses, and numbers of watercraft that the project will generate are compatible in <br />4977 relation to the suitability of public waters to safely accommodate these watercrafts. <br />4978 6. Mitigation <br />4979 a. In evaluating all variances, conditional uses, zoning and building permit applications, the <br />4980 zoning authority shall require the property owner to address the following conditions, when <br />4981 related to and proportional to the impact, to meet the purpose of this ordinance, to protect <br />4982 adjacent properties, and the public interest: <br />4983 i. Advanced storm water runoff management treatment; <br />4984 ii. Reducing impervious surfaces; <br />4985 iii. Increasing setbacks from the ordinary high water level; <br />4986 iv. Restoration of wetlands; <br />4987 v. Limiting vegetation removal and/or riparian vegetation restoration; <br />4988 vi. Provisions for the location, design, and use of structures, sewage treatment systems, water <br />4989 supply systems, watercraft launching and docking areas, and parking areas; and <br />4990 vii. Other conditions the zoning authority deems necessary. <br />4991 b. In evaluating plans to construct sewage treatment systems, roads, driveways, structures, or <br />4992 other improvements on steep slopes, conditions to prevent erosion and to preserve existing <br />4993 vegetation screening of structures, vehicles, and other facilities as viewed from the surface of <br />4994 public waters assuming summer, leaf-on vegetation shall be attached to permits. <br />4995 7. Nonconformities <br />4996 a. All legally established nonconformities as of the date of this ordinance may continue, but will <br />4997 be managed according to Minnesota Statues, 462.357 Subd. 1e and other regulations of this <br />14 <br /> <br />
