Attachment <br />Proposed Shoreland Ordinance Update <br />4998 community for alterations and additions; repair after damage; discontinuance of use; and <br />4999 intensification of use. <br />5000 b. All additions or expansions to the outside dimensions of an existing nonconforming structure <br />5001 must meet the setback, height, and other requirements of Sections 1012.03.E to 1012.03.H of <br />5002 this ordinance. Any deviation from these requirements must be authorized by a variance. <br />5003 8. Notifications to the Department of Natural Resources <br />5004 a. All amendments to this shoreland ordinance must be submitted to the Department of Natural <br />5005 Resources for review and approval for compliance with the statewide shoreland management <br />5006 rules. The City of Roseville will submit the proposed ordinance amendments to the <br />5007 commissioner or the commissionerÓs designated representative at least 30 days before any <br />5008 scheduled public hearings. <br />5009 b. All notices of public hearings to consider variances, ordinance amendments, or conditional <br />5010 uses under shoreland management controls must be sent to the commissioner or the <br />5011 commissionerÓs designated representative at least ten (10) days before the hearings. Notices <br />5012 of hearings to consider proposed subdivisions/plats must include copies of the <br />5013 subdivision/plat. <br />5014 c. All approved ordinance amendments and subdivisions/plats, and final decisions approving <br />5015 variances or conditional uses under local shoreland management controls must be sent to the <br />5016 commissioner or the commissionerÓs designated representative and postmarked within ten <br />5017 days of final action. When a variance is approved after the Department of Natural Resources <br />5018 has formally recommended denial in the hearing record, the notification of the approved <br />5019 variance shall also include the summary of the public record/testimony and the findings of <br />5020 facts and conclusions which supported the issuance of the variance. <br />5021 d. Any request to change the shoreland management classification of public waters within the <br />5022 City of Roseville must be sent to the commissioner or the commissionerÓs designated <br />5023 representative for approval, and must include a resolution and supporting data as required by <br />5024 Minnesota Rules, part 6120.3000, subp.4. <br />5025 e. Any request to reduce the boundaries of shorelands of public waters within City of Roseville <br />5026 must be sent to the commissioner or the commissionerÓs designated representative for <br />5027 approval and must include a resolution and supporting data The boundaries of shorelands may <br />5028 be reduced when the shoreland of water bodies with different classifications overlap. In these <br />5029 cases, the topographic divide between the water bodies shall be used for adjusting the <br />5030 boundaries. <br />5031 9. Mandatory EAW: An Environmental Assessment Worksheet consistent with Minnesota Rules, <br />5032 Chapter 4410 must be prepared for projects meeting the thresholds of Minnesota Rules, part <br />5033 4410.4300, Subparts 19a, 20a, 25, 27, 28, 29, and 36a. <br />5034 10. Planned Unit Development: A planned unit development (PUD) may be permitted within the <br />5035 Shoreland Overlay District as long as it follows the requirements of Chapter 1024 Planned Unit <br />5036 Developments and Section 1012.03.J below. <br />5037 D.
