Setbacks of decks: Deck additions may be allowed without a variance to a structure not <br />5182 meeting the required setback from the ordinary high water level if all of the following <br />5183 criteria are met. <br />5184 A. The structure existed on the date the structure setbacks were established; <br />5185 B. A thorough evaluation of the property and structure reveals no reasonable location for <br />5186 a deck meeting or exceeding the existing ordinary high water level setback of the <br />5187 structure; <br />5188 C. The deck encroachment toward the ordinary high water level does not exceed 15 <br />5189 percent of the existing setback of the structure from the ordinary high water level or <br />5190 is no closer than 30 feet from the OHWL, whichever is more restrictive; and <br />5191 D. The deck is constructed primarily of wood or composite materials having the <br />5192 appearance of wood, and is not roofed or screened (see Figure 1012-8). <br />21 <br /> <br />
