Such debris shall be collected and 365 disposed of according to state and federal laws governing solidwaste. 366 b.Fuel and chemical residue or other types of potentially harmfulmaterial, 367 such as animal waste, garbage or batteries shall be contained 368 immediately, removed as soon as possible and disposed of according to 369 state and federal laws governing solidwaste. 370 I.Industrial or Construction Activity Discharges. Any person subject to an 371 industrial activity NPDES storm waterstormwaterdischarge permit shall comply 372 with all provisions of such permit. Proof of compliance with said permit may be 373 required in a manner acceptable to the Public Works Director prior to the 374 allowing of discharges to the storm sewer system. Any person responsible for a 375 property or premise, who is, or may be, the source of an illicit discharge, may be 376 required to implement, at said person's expense, additional structural and non- 377 structural BMPs to prevent the further discharge of pollutants to the storm sewer 378 system. These BMPs shall be part of a storm waterstormwaterpollution 379 prevention plan (SWPPP) as necessary for compliance with requirements of the 380 NPDESpermit. 381 J.Access toFacilities 382 1.When the City has determined that there is a danger to the health, safetyor 383 welfare of the public, city representatives shall be permitted to enter and 384 inspect facilities subject to regulation under this ordinancetodetermine 385 compliance with this ordinance. If a discharger has security measures in 386 force which require proper identification and clearance before entry into its 387 premises, the discharger shall make the necessary arrangements to allow 388 access to city representatives. 389 2.In lieu of an inspection by a City representative, the property owner shall 390 furnish a certificate from a licensed plumber, in a form acceptable to theCity, 391 certifying that the property has not discharged prohibited material into the 392 municipalstorm sewer system. Failure to provide such certificate of 393 compliance shall make the property owner immediately subject to the 394 suspension of storm sewer access as provided for in section M of this section 395 until the property is inspected and/or compliance is met, including any 396 penalties and remedies as set forth in section N below. 397 3.Unreasonable delays in allowing city representatives access to a permitted 398 facility is a violation of a storm waterstormwaterdischarge permit and of 399 thisordinance. 400 4.The City mayseek issuance of a search warrant for the followingreasons: 401 a.If city representatives are refused access to any part of the premisesfrom 402 which storm waterstormwateris discharged, and there is probable cause 403 to believe that there may be a violation of this ordinance;or 404 b.there is a need to inspect and/or sample as part of a routine inspectionand 405 sampling program designed to verify compliance with this ordinance or 406 any order issued hereunder;or 407 c.to protect the overall public health, safety, and welfare of thecommunity. 408 K.Watercourse Protection. Every person owning property through which a 409 watercourse passes or is directly adjacent to a watercourse, shall keep and 410 maintain that part of the watercourse free of trash, debris, and other obstacles 411 that would pollute, contaminate, or retard the flow of water through the 412 watercourse. In addition, the owner or lessee shall maintain existing privately 413 owned structures within or adjacent to a watercourse, so that such structureswill 414 not become a hazard to the use, function, or physical integrity of the 415 watercourse. 416 L.Notification of Spills. Notwithstanding other requirements of law, as soon as
