Such debris shall be collected and <br />365 disposed of according to state and federal laws governing solidwaste. <br />366 b.Fuel and chemical residue or other types of potentially harmfulmaterial, <br />367 such as animal waste, garbage or batteries shall be contained <br />368 immediately, removed as soon as possible and disposed of according to <br />369 state and federal laws governing solidwaste. <br />370 I.Industrial or Construction Activity Discharges. Any person subject to an <br />371 industrial activity NPDES storm waterstormwaterdischarge permit shall comply <br />372 with all provisions of such permit. Proof of compliance with said permit may be <br />373 required in a manner acceptable to the Public Works Director prior to the <br />374 allowing of discharges to the storm sewer system. Any person responsible for a <br />375 property or premise, who is, or may be, the source of an illicit discharge, may be <br />376 required to implement, at said person's expense, additional structural and non- <br />377 structural BMPs to prevent the further discharge of pollutants to the storm sewer <br />378 system. These BMPs shall be part of a storm waterstormwaterpollution <br />379 prevention plan (SWPPP) as necessary for compliance with requirements of the <br />380 NPDESpermit. <br />381 J.Access toFacilities <br />382 1.When the City has determined that there is a danger to the health, safetyor <br />383 welfare of the public, city representatives shall be permitted to enter and <br />384 inspect facilities subject to regulation under this ordinancetodetermine <br />385 compliance with this ordinance. If a discharger has security measures in <br />386 force which require proper identification and clearance before entry into its <br />387 premises, the discharger shall make the necessary arrangements to allow <br />388 access to city representatives. <br />389 2.In lieu of an inspection by a City representative, the property owner shall <br />390 furnish a certificate from a licensed plumber, in a form acceptable to theCity, <br />391 certifying that the property has not discharged prohibited material into the <br />392 municipalstorm sewer system. Failure to provide such certificate of <br />393 compliance shall make the property owner immediately subject to the <br />394 suspension of storm sewer access as provided for in section M of this section <br />395 until the property is inspected and/or compliance is met, including any <br />396 penalties and remedies as set forth in section N below. <br />397 3.Unreasonable delays in allowing city representatives access to a permitted <br />398 facility is a violation of a storm waterstormwaterdischarge permit and of <br />399 thisordinance. <br />400 4.The City mayseek issuance of a search warrant for the followingreasons: <br />401 a.If city representatives are refused access to any part of the premisesfrom <br />402 which storm waterstormwateris discharged, and there is probable cause <br />403 to believe that there may be a violation of this ordinance;or <br />404 b.there is a need to inspect and/or sample as part of a routine inspectionand <br />405 sampling program designed to verify compliance with this ordinance or <br />406 any order issued hereunder;or <br />407 c.to protect the overall public health, safety, and welfare of thecommunity. <br />408 K.Watercourse Protection. Every person owning property through which a <br />409 watercourse passes or is directly adjacent to a watercourse, shall keep and <br />410 maintain that part of the watercourse free of trash, debris, and other obstacles <br />411 that would pollute, contaminate, or retard the flow of water through the <br />412 watercourse. In addition, the owner or lessee shall maintain existing privately <br />413 owned structures within or adjacent to a watercourse, so that such structureswill <br />414 not become a hazard to the use, function, or physical integrity of the <br />415 watercourse. <br />416 L.Notification of Spills. Notwithstanding other requirements of law, as soon as <br /> <br />
