<br />30 January 26, 2023:Community Development Director Janice Gundlach met with <br />31 representataives of Prince of Peace (including Pastor Christ), Settled, and the occupants of the <br />32 Units to discuss concerns surrounding the placement of the Unitsand their compliance with <br />33 various Zoning Code, City Code, and Building Code requirements. This meeting included a <br />34 tour of both Units. <br />35 February 1, 2023: Prince of Peace was provided a written letter (Attachment D) outlining non- <br />36 compliance issues, including three options for seeking a resolution. <br />37 February 10, 2023: City staff received a response from Prince of Peace (Attachment E) to the <br />st <br />38 February 1non-compliance letter, including a request to appealthe determination that the <br />39 Units were not permitted uses under the Zoning Code. <br />40 The staff determination the Units are not permissible under the Zoning Code is due to the following: <br />41 Zoning Code Section 1001.10: Definitions of “Building”, “Dwelling”, and “Dwelling Unit”, <br />42 which require living quarters to have permanent locations on the ground, or attached to <br />43 something having a permanent location on the ground, and includekitchen facilities and <br />44 individual bathrooms. The Units sit on trailers and therefore are not considered to have a <br />45 permanent location on the ground. One unit lacks a bathroom entirely, whereas the other unit <br />46 utilizes a five gallon bucket with cat litter for a toilet.Neither has plumbed kitchen facilities. <br />47 Recreational Camping is not permitted by the Zoning Code: The Zoning Code does not permit <br />48 recreational camping areas anywhere in the City. There is one exception, which allows use of <br />49 up to four recreational vehicles at the Roseville Estates Mobile Home Park as a part of Planned <br />50 Unit Development Agreement #1256 approved on December 17, 2001, however, this approval <br />51 requires these four units be connected to City sewer and water lines. <br />52 In addition to the Zoning Code, the Units are in violation of the City Code due to the following: <br />53 City Code Section 801.03 (Public Works): Requires separate connections to municipal water <br />54 for each dwelling unit constructed on or after September 19, 1979. <br />55 City Code Section 802.03 (Public Works): Requires that any building used for human <br />56 habitation be connected to municipal sewer. <br />57 City Code Section 901.01 (Building): Requires construction acitivity within the City to <br />58 comply with the current Minnesota State Building Code (MSBC). The MSBC requires <br />59 housing for permanent, single-family occupancy to meet 2020 Minnesota Residential Codes. <br />60 Permits were not applied for, nor were inspections undertaken to determine if the Unitsbrought <br />61 onto the property comply with the MSBC. At the very least, the Building Code includes <br />62 foundation requirements for buildings, as well as plumbing requirements for buidings intended <br />63 for human habitation, neither of which the Units comply with. <br />64 City Code Section 906.05 (Property Maintenance): Requires foundation systems supported by <br />65 footings or properly anchored and capable of supporting nominal loads and resisting load <br />66 effects. <br />Page 2 of 5 <br />RS160\\1\\859178.v1 <br /> <br />
