A certificate of compliance, consistent with Minnesota Rules Chapter 7082.0700 Subp. 3, is <br />281 required whenever a permit or variance of any type is required for any improvement on or use <br />282 of the property. <br />283 3.Application Materials: Application for permits and other zoning applications such as variances <br />284 shall be made to the Community Development Department on the forms provided. The <br />285 application shall include the necessary information so that the Community Development Director <br />286 can evaluate how the application complies with the provisions of this ordinance. <br />287 4. Variances: Variances may only be granted in accordance with Minnesota Statutes, Section <br />288 462.357 and are subject to the following: <br />289 a. A variance may not circumvent the general purposes and intent of this ordinance; and <br />290 b. Variances that allow a structure to be located within the ordinary high water level setback or <br />291 that allow more impervious surface coverage than the standard shall include the following <br />292 minimum conditions: <br />293 i. The greater of 20 feet or 20% of contiguous shoreline to a depth of 10 feet shall be <br />294 restored with trees, shrubs, and low ground covers consisting of native plants which are <br />295 consistent with the natural cover of the shoreline. <br />296 ii. A planting plan which is acceptable to City Staff shall be submitted that demonstrates <br />297 how the restoration will occur. <br />298 iii. Either a conservation easement for the restored area shall be established and recorded, or <br />299 signage following City policies shall be installed and maintained around the restoration <br />300 area. <br />301 5. Conditional Uses: All conditional uses in the shoreland area are subject to a thorough evaluation <br />302 of the waterbody and the topographic, vegetation, and soil conditions to ensure: <br />303 a. The prevention of soil erosion or other possible pollution of public waters, both during and <br />304 after construction; <br />305 b. The visibility of structures and other facilities as viewed from public waters is limited; <br />306 c.There is adequate water supply and on-site sewage treatment; and <br />307 d. The types, uses, and numbers of watercraft that the project will generate are compatible in <br />308 relation to the suitability of public waters to safely accommodate these watercrafts. <br />309 6. Mitigation <br />310 a. In evaluating all variances, conditional uses, zoning and building permit applications, the <br />311 zoning authority shall require the property owner to address the following conditions, when <br />312 related to and proportional to the impact, to meet the purpose of this ordinance, to protect <br />313 adjacent properties, and the public interest: <br />314 i. Advanced storm water runoff management treatment; <br />315 ii. Reducing impervious surfaces; <br />316 iii. Increasing setbacks from the ordinary high water level; <br />Page 11 of 32 <br /> <br />
