Provisions for the location, design, and use of structures, sewage treatment systems, water 320 supply systems, watercraft launching and docking areas, and parking areas; and 321 vii. Other conditions the zoning authority deems necessary. 322 b. In evaluating plans to construct sewage treatment systems, roads, driveways, structures, or 323 other improvements on steep slopes, conditions to prevent erosion and to preserve existing 324 vegetation screening of structures, vehicles, and other facilities as viewed from the surface of 325 public waters assuming summer, leaf-on vegetation shall be attached to permits. 326 7. Nonconformities 327 a. All legally established nonconformities as of the date of this ordinance may continue, but will 328 be managed according to Minnesota Statues, 462.357 Subd. 1e and other regulations of this 329 community for alterations and additions; repair after damage; discontinuance of use; and 330 intensification of use. 331 b. All additions or expansions to the outside dimensions of an existing nonconforming structure 332 must meet the setback, height, and other requirements of Sections 1012.03.E to 1012.03.H of 333 this ordinance. Any deviation from these requirements must be authorized by a variance. 334 8. Notifications to the Department of Natural Resources 335 a. All amendments to this shoreland ordinance must be submitted to the Department of Natural 336 Resources for review and approval for compliance with the statewide shoreland management 337 rules. The City of Roseville will submit the proposed ordinance amendments to the 338 commissioner or the commissionerÓs designated representative at least 30 days before any 339 scheduled public hearings. 340 b. All notices of public hearings to consider variances, ordinance amendments, or conditional 341 uses under shoreland management controls must be sent to the commissioner or the 342 commissionerÓs designated representative at least ten (10) days before the hearings. Notices 343 of hearings to consider proposed subdivisions/plats must include copies of the 344 subdivision/plat. 345 c. All approved ordinance amendments and subdivisions/plats, and final decisions approving 346 variances or conditional uses under local shoreland management controls must be sent to the 347 commissioner or the commissionerÓs designated representative and postmarked within ten 348 days of final action. When a variance is approved after the Department of Natural Resources 349 has formally recommended denial in the hearing record, the notification of the approved 350 variance shall also include the summary of the public record/testimony and the findings of 351 facts and conclusions which supported the issuance of the variance. 352 d. Any request to change the shoreland management classification of public waters within the 353 City of Roseville must be sent to the commissioner or the commissionerÓs designated 354 representative for approval, and must include a resolution and supporting data as required by 355 Minnesota Rules, part 6120.3000, subp.4.
