RCA Attachment A <br />317 iv. Restoration of wetlands; <br />318 v. Limiting vegetation removal and/or riparian vegetation restoration; <br />319 vi. Provisions for the location, design, and use of structures, sewage treatment systems, water <br />320 supply systems, watercraft launching and docking areas, and parking areas; and <br />321 vii. Other conditions the zoning authority deems necessary. <br />322 b. In evaluating plans to construct sewage treatment systems, roads, driveways, structures, or <br />323 other improvements on steep slopes, conditions to prevent erosion and to preserve existing <br />324 vegetation screening of structures, vehicles, and other facilities as viewed from the surface of <br />325 public waters assuming summer, leaf-on vegetation shall be attached to permits. <br />326 7. Nonconformities <br />327 a. All legally established nonconformities as of the date of this ordinance may continue, but will <br />328 be managed according to Minnesota Statues, 462.357 Subd. 1e and other regulations of this <br />329 community for alterations and additions; repair after damage; discontinuance of use; and <br />330 intensification of use. <br />331 b. All additions or expansions to the outside dimensions of an existing nonconforming structure <br />332 must meet the setback, height, and other requirements of Sections 1012.03.E to 1012.03.H of <br />333 this ordinance. Any deviation from these requirements must be authorized by a variance. <br />334 8. Notifications to the Department of Natural Resources <br />335 a. All amendments to this shoreland ordinance must be submitted to the Department of Natural <br />336 Resources for review and approval for compliance with the statewide shoreland management <br />337 rules. The City of Roseville will submit the proposed ordinance amendments to the <br />338 commissioner or the commissionerÓs designated representative at least 30 days before any <br />339 scheduled public hearings. <br />340 b. All notices of public hearings to consider variances, ordinance amendments, or conditional <br />341 uses under shoreland management controls must be sent to the commissioner or the <br />342 commissionerÓs designated representative at least ten (10) days before the hearings. Notices <br />343 of hearings to consider proposed subdivisions/plats must include copies of the <br />344 subdivision/plat. <br />345 c. All approved ordinance amendments and subdivisions/plats, and final decisions approving <br />346 variances or conditional uses under local shoreland management controls must be sent to the <br />347 commissioner or the commissionerÓs designated representative and postmarked within ten <br />348 days of final action. When a variance is approved after the Department of Natural Resources <br />349 has formally recommended denial in the hearing record, the notification of the approved <br />350 variance shall also include the summary of the public record/testimony and the findings of <br />351 facts and conclusions which supported the issuance of the variance. <br />352 d. Any request to change the shoreland management classification of public waters within the <br />353 City of Roseville must be sent to the commissioner or the commissionerÓs designated <br />354 representative for approval, and must include a resolution and supporting data as required by <br />355 Minnesota Rules, part 6120.3000, subp.4. <br />Page 12 of 32 <br /> <br />
