REQUEST FOR COUNCIL ACTION <br />Date:February 13, 2023 <br />Item No.:7.c <br />Department ApprovalCity Manager Approval <br />Item Description:Presumptive Penalty Approval –2022 TobaccoCompliance Checks, <br />Speedway <br />1 B ACKGROUND <br />2 In 2022, all businesses with a city tobaccolicense were mailed a letter announcing two citywide <br />3 tobaccocompliance checks to be conducted before the end of the calendar year(Attachment A). A <br />4 copy of the letter was also e-mailed to all license holders.The following is related to the second <br />5 round of tobaccocompliance checks, which occurred in Decemberof 2022. <br />6 OnSaturday, December17, 2022, a19-year-old underage compliance checker, entered <br />7 establishments holding a tobaccolicense in the city of Roseville, Minnesota, to conduct compliance <br />8 checks(Attachment B). <br />9 Speedway (CN 22036927) -The underage checker ordered a pack of Swisher Sweet Cigarsand a <br />10 six pack of MichelobUltra. The employee then telephoned a manager and received information on <br />11 how to unlock the secured alcohol cabinet. After locating the key, the employee retrieved the beer. <br />12 Without asking for identification or inquiring as to the checkers age, the employee sold the checker <br />13 the cigars and beer. To date, the employee has not paid the administrative fine. <br />14 Officersmet with thebusiness in-person and advised them of theRoseville City Councilhearing <br />15 date.
