Denial of Application: The license application may be denied for any of the 191 following reasons: 192 1. Fraudulent Statements: The application contains false, fraudulent, or 193 deceptive statements. 194 2. Prior Conviction: The applicant has been convicted of or entered a plea 195 of guilty within the previous three years to a violation of this Chapter or 196 of any other law regulating the practice of massage, or of any law 197 prohibiting criminal sexual conduct, prostitution, or indecent conduct. 198 3. Noncompliance: The applicant has not complied with a provision of this 199 Chapter. 200 4. Underage: The applicant is less than eighteen (18) years of age. (Ord. 201 1142, 6- 13-94) 202 5. Prior Denial, Revocation, or Suspension: The applicant has had a 203 massage therapist license denied, revoked, or suspended in another 204 jurisdiction. 205 6. Violation of Chapter: A violation of any provision of this Chapter. 206 7. Unlawful Conduct. Any unlawful conduct including, but not limited to, 207 criminal sexual conduct, prostitution, or indecent conduct, regardless of 208 whether such conduct resulted in a criminal conviction. 209 8. Violations of Law Relating to Practice of Massage Therapy. Any 210 violation of laws or ordinances relating to the practice of massage 211 therapy, regardless of whether such conduct resulted in a criminal 212 conviction. 213 9. In the event of a license denial based solely or in part on a criminal 214 conviction, the City will follow the process outlined in Minnesota 215 Statutes Chapter 364. 216 10. Lack of Skill: Exhibition of a demonstrable lack of skill in the practice 217 of massage therapy. (Ord. 1142, 6-13-94) 218 219 309.06: RESTRICTIONS AND REGULATIONS FOR MASSAGE THERAPY 220 ESTABLISHMENTS AND MASSAGE THERAPIST LICENSES: 221 A. Display of License: Any person registered as a massage therapist hereunder 222 shall display such license, with a color photo or a true copy thereof, on the 223 premises at which the therapist is employed. 224 B.Identification: Upon demand of any police officer at the place of employment, 225 any person licensed hereunder shall produce valid photo identification, 226 identifying himself/herself by his/her true legal name and proof of address.
