Ord. 1329, 11-14-05) <br />185 C.Review of Application: Notwithstanding Section 301.02 of City Code, License <br />186 applications shall be reviewed and decided upon by the City Manager or <br />187 designee and shall include a review by the Police Department or other qualified <br />188 service providers in conducting and completing criminal background checks. <br />189 (Ord 1615, 07-25-2022) <br />190 D. Denial of Application: The license application may be denied for any of the <br />191 following reasons: <br />192 1. Fraudulent Statements: The application contains false, fraudulent, or <br />193 deceptive statements. <br />194 2. Prior Conviction: The applicant has been convicted of or entered a plea <br />195 of guilty within the previous three years to a violation of this Chapter or <br />196 of any other law regulating the practice of massage, or of any law <br />197 prohibiting criminal sexual conduct, prostitution, or indecent conduct. <br />198 3. Noncompliance: The applicant has not complied with a provision of this <br />199 Chapter. <br />200 4. Underage: The applicant is less than eighteen (18) years of age. Prior Denial, Revocation, or Suspension: The applicant has had a <br />203 massage therapist license denied, revoked, or suspended in another <br />204 jurisdiction. <br />205 6. Violation of Chapter: A violation of any provision of this Chapter. <br />206 7. Unlawful Conduct. Any unlawful conduct including, but not limited to, <br />207 criminal sexual conduct, prostitution, or indecent conduct, regardless of <br />208 whether such conduct resulted in a criminal conviction. <br />209 8. Violations of Law Relating to Practice of Massage Therapy. Any <br />210 violation of laws or ordinances relating to the practice of massage <br />211 therapy, regardless of whether such conduct resulted in a criminal <br />212 conviction. <br />213 9. In the event of a license denial based solely or in part on a criminal <br />214 conviction, the City will follow the process outlined in Minnesota <br />215 Statutes Chapter 364. <br />216 10. Lack of Skill: Exhibition of a demonstrable lack of skill in the practice <br />217 of massage therapy. (Ord. 1142, 6-13-94) <br />218 <br />219 309.06: RESTRICTIONS AND REGULATIONS FOR MASSAGE THERAPY <br />220 ESTABLISHMENTS AND MASSAGE THERAPIST LICENSES: <br />221 A. Display of License: Any person registered as a massage therapist hereunder <br />222 shall display such license, with a color photo or a true copy thereof, on the <br />223 premises at which the therapist is employed. <br />224 B.Identification: Upon demand of any police officer at the place of employment, <br />225 any person licensed hereunder shall produce valid photo identification, <br />226 identifying himself/herself by his/her true legal name and proof of address. <br />Final Draft 4.24.23 <br /> <br />
