Attachment C 227 C.Inspection: The issuing authority, or designee, and/or the City Police 228 Department shall have the right to enter and inspect the licensed premise during 229 the hours in which the licensed premise is open for business. 230 D.Transfer of establishment license. A Massage Establishment License may be 231 transferred by a license holder to another person at the licensed location, 232 provided that the transferee files a license application and meets the 233 requirements to hold a license. A Massage Establishment License may be 234 transferred by a license holder to another location to be operated by that license 235 holder, provided that the license holder files a license application and the new 236 location meets the location requirements. 237 E. Hours: No customers or patrons shall be allowed to enter or remain on the 238 licensed premises before 8:00 A.M. or after 9:00 P.M. daily. 239 F. The establishment may only provide services during business hours which must 240 be posted on the door. Except in the case of a Massage Establishment where the 241 license is held by the sole Licensed Therapist at the business, the business must 242 be staffed at all times during such posted hours. 243 G. Alcohol or Drugs Prohibited: No beer, liquor, narcotic drug or controlled 244 substance, as such terms are defined by State statutes or the City Code shall be 245 permitted on licensed premises. 246 H. Violation of Building, Safety or Health Regulations: Violation of any law or 247 regulation relating to building, safety or health shall be grounds for revocation 248 or any license. 249 I. Locks on Doors: There shall be no locks on doors of massage rooms. 250 J. Appropriate Covering Required: 251 1. Patron: Whenever a massage is given, it shall be required by the massage 252 therapist that the person who is receiving the massage shall have her breasts 253 and his/her buttocks and genitals covered with a nontransparent material. 254 For purposes of receiving a chair massage, patrons must stay fully-clothed 255 at all times. Therapist: Any massage therapists performing any massages shall at all 257 times have their breasts and his/her buttocks and genitals covered with a 258 nontransparent material. (Ord. 1142, 6-13-94) 259 K. Massage of certain body parts prohibited. At no time shall the massage therapist 260 intentionally massage or offer to massage the breasts, penis, scrotum, mons 261 veneris, vulva or vaginal area of a person. 262 L. With the exception of chair massages, all other types of massages shall take 263 place in a private room subject to the conditions and restrictions noted above. 264 (Ord. 1329, 11-14-05) (Ord. 1529, 6/19/2017) 265 M. Licensed premises: A massage therapy establishment license is only effective 266 for the compact and contiguous space specified in the approved license 267 application. If the licensed premises is enlarged, altered or extended, the 268 licensee shall inform the issuing authority. 269 N. Affiliation with establishment is required. A massage therapist must be 270 employed by, contractually affiliated with or owna massage therapy 271 establishment licensed by the city, unless a person or entity is specifically Final Draft 4.24.23
