Attachment C <br />227 C.Inspection: The issuing authority, or designee, and/or the City Police <br />228 Department shall have the right to enter and inspect the licensed premise during <br />229 the hours in which the licensed premise is open for business. <br />230 D.Transfer of establishment license. A Massage Establishment License may be <br />231 transferred by a license holder to another person at the licensed location, <br />232 provided that the transferee files a license application and meets the <br />233 requirements to hold a license. A Massage Establishment License may be <br />234 transferred by a license holder to another location to be operated by that license <br />235 holder, provided that the license holder files a license application and the new <br />236 location meets the location requirements. <br />237 E. Hours: No customers or patrons shall be allowed to enter or remain on the <br />238 licensed premises before 8:00 A.M. or after 9:00 P.M. daily. <br />239 F. The establishment may only provide services during business hours which must <br />240 be posted on the door. Except in the case of a Massage Establishment where the <br />241 license is held by the sole Licensed Therapist at the business, the business must <br />242 be staffed at all times during such posted hours. <br />243 G. Alcohol or Drugs Prohibited: No beer, liquor, narcotic drug or controlled <br />244 substance, as such terms are defined by State statutes or the City Code shall be <br />245 permitted on licensed premises. <br />246 H. Violation of Building, Safety or Health Regulations: Violation of any law or <br />247 regulation relating to building, safety or health shall be grounds for revocation <br />248 or any license. <br />249 I. Locks on Doors: There shall be no locks on doors of massage rooms. <br />250 J. Appropriate Covering Required: <br />251 1. Patron: Whenever a massage is given, it shall be required by the massage <br />252 therapist that the person who is receiving the massage shall have her breasts <br />253 and his/her buttocks and genitals covered with a nontransparent material. <br />254 For purposes of receiving a chair massage, patrons must stay fully-clothed <br />255 at all times. Therapist: Any massage therapists performing any massages shall at all <br />257 times have their breasts and his/her buttocks and genitals covered with a <br />258 nontransparent material. (Ord. 1142, 6-13-94) <br />259 K. Massage of certain body parts prohibited. At no time shall the massage therapist <br />260 intentionally massage or offer to massage the breasts, penis, scrotum, mons <br />261 veneris, vulva or vaginal area of a person. <br />262 L. With the exception of chair massages, all other types of massages shall take <br />263 place in a private room subject to the conditions and restrictions noted above. <br />264 (Ord. 1329, 11-14-05) (Ord. 1529, 6/19/2017) <br />265 M. Licensed premises: A massage therapy establishment license is only effective <br />266 for the compact and contiguous space specified in the approved license <br />267 application. If the licensed premises is enlarged, altered or extended, the <br />268 licensee shall inform the issuing authority. <br />269 N. Affiliation with establishment is required.
