Equity was raised and if the City passes laws that no one follows it gives <br />219 law enforcement the ability to pull over anyone they want to. Do not pass laws that <br />220 no one is going to follow, and scenarios will not be created like that. He indicated <br />221 if the Commission wanted to do a study or a survey of people, he would encourage <br />222 the Commission to take a look at the recycling survey that was done. <br />223 <br />224 8. Pavement Management Update <br />225 Public Works Director Jesse Freihammer provided a pavement management update <br />226 to the Commission. dw <br />227 <br />228 Member Luongo indicated in some places the homeowner gets an assessment if the <br />229 road in front of the house is reconstructed and she had never heard of this before <br />230 moving to Minnesota. <br />231 r <br />232 Mr. Freihammer explained Roseville has an assessment policy and typically only <br />233 assesses for reconstruction. As a part of the County Road B reconstruct, there will <br />234 be assessments. The City does not assess what is considered maintenance projects <br />235 and the City considers mill and overlay maintenance. Every city in Minnesota has <br />236 a different policy, a different rate and varies dramatically. <br />237 <br />238 The staff discussed with the Commission assessment calculations. <br />239 <br />240 Mr. John Kysylyczyn reviewed with the Commission different sections of <br />241 Minnesota Statutes regarding assessments on bonding. He explained if the City <br />242 wishes to bond for a project, the City has to assess twenty percent in order to bond <br />243 without a voter referendum. If the City wanted to assess fifteen percent, it would <br />244 require a vote of the people so that is why this number is around twenty percent or <br />245 higher and has to do with Statutes. The County follows under a different Statute <br />246 that does not have the assessment requirement attached to it and is why the County <br />247 does not assess and why the City does. It is all based on Statute. <br />248 <br />249 9.
