In the City Code, the serving of alcohol or providing of the alcohol is <br /> what is applied so while there was a multi-layer approach and the true individual <br /> who served the alcohol to the minor was the person that was cited. <br /> Mr.Ronald Walsh,counsel for Mito,Mr. Jonathan Soto, and Ms. Ellie Petros,were <br /> at the meeting to answer questions, take responsibility, and advise the Council of <br /> steps that have been taken to make sure this does not happen again. <br /> Mr. Walsh explained the citation has been paid by the server and that person has <br /> been terminated. His client has retrained their employees and made significant <br /> investments in purchasing scanners so that should take out a lot of the guesswork. <br /> He indicated this is a first offense and asked for a suspension of the one day or at <br /> least some grace on the day selected for the suspension so it is not a weekend date, <br /> which is a busy few days for them. <br /> Ms. Petros indicated the person who checked the IDs at the top of the stairs has also <br /> been terminated. <br /> Mr. Walsh indicated the entire security staff has been terminated and a whole new <br /> staff has been brought in. <br /> Mayor Roe asked if the downstairs is an age-restricted area. If so, once the ID has <br /> been checked would there be a way, such as hand stamps, bracelets, or something <br /> else that could be used. <br /> Ms. Petros explained what they do now is if someone comes into the establishment <br /> their ID is checked at the top of the stairs, they get scanned with the new scanners, <br /> and get a wrist band. Once downstairs the bar area is restricted, only 21 and older, <br /> and anyone under that is not allowed access by a security guard in place. At the <br /> bar, the person is ID'd again, even if wearing a wrist band. <br /> Public Comment <br /> Mayor Roe offered an opportunity for public comment with no one coming <br /> forward. <br /> Etten moved, Groff seconded, approval to issue and administer the presumptive <br /> penalty pursuant to City Code Section 302.15, for on-sale license holders for the <br /> first violation within thirty-six(36)months. The mandatory minimum penalty shall <br /> be a one-thousand-dollar($1,000.00) fine and a one(1) day suspension. <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br />
