Regular City Council Meeting <br /> Monday, October 9, 2023 <br /> Page 3 <br /> make an excuse;they are at the meeting to talk about a reason and why they believe <br /> that there are mitigating circumstances. <br /> Mr. Haddy explained he has two letters from the children's hospital of Minnesota <br /> that details the seriousness regarding the birth of his child and why his mind was <br /> some place else other than at that moment selling a pack of cigarettes. He explained <br /> Mr. Elkhoderi treats this very seriously and as mentioned, this is his first offense. <br /> Mr. Elkhoderi also came in right away to pay the $250 fine. He was requested to <br /> take the course of Stop Sales to Minors,which he took on September 27, 2023 and <br /> received the congratulations email that he had passed the course. Mr. Elkhoderi is <br /> asking the members of this body to consider those circumstances as it makes a <br /> decision on those presumptive rules. He is asking that any suspension of time be <br /> reduced from seven days and in addition, he is asking that a fine be reduced from <br /> $2,000 to something significantly less because, like all of them, money is very <br /> important to him. Mr. Elkhoderi also stands here tonight either through him or by <br /> himself, willing to answer any questions by the Council. <br /> Mayor Roe asked if there were any questions for the representative or owner of the <br /> business. <br /> The Council did not have any questions. <br /> Public Comment <br /> Mayor Roe offered an opportunity for public comment with no one coming <br /> forward. <br /> Council Discussion <br /> Councilmember Etten asked if this same owner was in charge of this establishment <br /> for the previous violations. <br /> Deputy Chief Adams indicated he could not answer that question confidently, but <br /> he did believe that when the department has the continued violations it is for the <br /> same ownership. <br /> Mayor Roe asked if this was the second violation, what would the fine and <br /> suspension be. <br /> Deputy Chief Adams indicated the fine would be $2,000 with a three-day <br /> suspension. <br /> Strahan moved, Groff seconded, approval to issue and administer the presumptive <br /> penalty pursuant to City Code Section 309.09, for tobacco license holders for the <br />
