Consider Presumptive Penalty Approval — 2023 Tobacco Compliance Check <br /> (Quickmart) <br /> Deputy Police Chief Joe Adams briefly highlighted this item as detailed in the <br /> Request for Council Action and related attachments dated October 9, 2023. <br /> Councilmember Strahan wondered what happens if the business gets a fourth <br /> violation. <br /> Deputy Police Chief Adams indicated if the business gets a fourth violation within <br /> 36 months the business would receive a license revocation. <br /> Mr. Brad Haddy, attorney representing Mr. Ahmed Elkhoderi, owner of the <br /> Quickmart, indicated one of the reasons he was at the meeting with Mr. Elkhoderi <br /> is for translation. He explained Mr. Elkhoderi has been a client of his for a number <br /> of years. He explained as an attorney, they look at things in the totality of <br /> circumstances and that is what he is asking this Council to do in considering a <br /> downward deviation from the presumptive rule within the guidelines or code from <br /> Roseville. Mr. Elkhoderi is aware that this is the third offense within 36 months. <br /> Mr. Elkhoderi has worked at convenience stores and his particular Quickmart that <br /> he owns, for a total of fifteen years and this is his personal first violation. More <br /> than that, the morning this happened, he had received an emergency telephone call <br /> from the hospital where his wife was delivering a baby and the child was under <br /> emergency medical care, so his mind was in another place. He does understand <br /> that he did not properly check the ID. He indicated they were not at the meeting to <br />
