Regular City Council Meeting <br /> Monday, October 9,2023 <br /> Page 5 <br /> Mayor Roe offered an opportunity for public comment with no one coming <br /> forward. <br /> Council Discussion <br /> Councilmember Etten asked if the person who received the violation was an <br /> employee or just a friend of the manager. <br /> Deputy Chief Adams explained it was the understanding that the person was a <br /> friend and not an employee of the store. <br /> Schroeder moved, Etten seconded, approval to issue and administer the <br /> presumptive penalty pursuant to City Code Section 306.09, for tobacco license <br /> holders for the second violation within thirty-six (36) months. The mandatory <br /> minimum penalty shall be a two-thousand-dollar ($2,000.00) fine and a three (3) <br /> day suspension. <br /> Council Discussion <br /> Councilmember Schroeder echoed the same comments from the previous item. <br /> Mayor Roe noted that sometimes the decision needs to be made that if you do not <br /> have someone that can identify people as to whether they are old enough to <br /> purchase the products, perhaps the decision needs to be made to temporarily close <br /> the business if the person running the business needs to leave. <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br /> c. Consider Presumptive Penalty Approval — 2023 Alcohol Compliance Check <br /> (Applebee's) <br /> Deputy Police Chief Joe Adams briefly highlighted this item as detailed in the <br /> Request for Council Action and related attachments dated October 9, 2023. <br /> Mr. Dallas Ward, general manager at Applebee's Roseville, explained Applebee's <br /> does take this very seriously. His staff has mandatory training when hired and then <br /> yearly updates as well. He explained this is their first violation and he would like <br /> to have some break,if possible, and asked if the Council had any questions for him. <br /> He indicated the employee was let go after he failed the compliance check. <br /> Public Comment <br /> Mayor Roe offered an opportunity for public comment. A remote participant was <br /> recognized to speak but made a racially offensive remark and was immediately <br />
