Regular City Council Meeting <br /> Monday, October 9, 2023 <br /> Page 6 <br /> removed from remote meeting participation. Mayor Roe apologized to the meeting <br /> attendees for having been subjected to that speaker's comment. <br /> Groff moved, Etten seconded, approval to issue and administer the presumptive <br /> penalty pursuant to City Code Section 302.15, for on-sale license holders for the <br /> first violation within thirty-six(36)months. The mandatory minimum penalty shall <br /> be a two-thousand-dollar($2,000.00) fine and a one (1) day suspension. <br /> Council Discussion <br /> Councilmember Groff thanked Applebee's for continuing their education process. <br /> He indicated this being the first violation in 36 months does not mean that things <br /> are not being done correctly but the City has to be very diligent. He thanked Mr. <br /> Ward for being at the meeting. <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br /> d. Consider Presumptive Penalty Approval — 2023 Alcohol Compliance Check <br /> (Chills) <br /> Deputy Police Chief Joe Adams briefly highlighted this item as detailed in the <br /> Request for Council Action and related attachments dated October 9, 2023. <br /> Councilmember Schroeder asked Deputy Chief Adams to verify that the underage <br /> license is a different orientation. She also asked what the difference was between <br /> the underage and over 21 license. <br /> Deputy Chief Adams explained the State of Minnesota has gone to great lengths <br /> over the past few years to make this as simple for individuals who check IDs as <br /> possible. The two different things to note are the orientation of the license if vertical <br /> versus horizontal and the second thing is bold letters saying "under 21" on the <br /> license. <br /> Mr. Brian Culpepper, director of operations of Breakers International, and Mr. C.J. <br /> Nottingham, general manager of Chili's in Roseville, were present at the meeting. <br /> Mr. Culpepper explained their team member acted irresponsibly and management <br /> is owning and accepts that. They have taken extra steps in the restaurant to card <br /> and verify every guest that orders alcoholic beverages. He explained the individual <br /> that did this was a fifteen-year team member and she was fired on the spot, per <br /> policy. <br /> Public Comment <br />
