Regular City Council Meeting <br /> Monday, October 23,2023 <br /> Page 2 <br /> Mayor Roe read the National Native American Heritage Month Proclamation. <br /> Strahan moved, Etten seconded, proclaiming November 2023, National Native <br /> American Heritage Month. <br /> Roll Call <br /> Ayes: Etten, Schroeder, Groff, Strahan, and Roe. <br /> Nays: None. <br /> 6. Items Removed from Consent Agenda <br /> a. Adopt an Ordinance Passing Zoning Code Text Amendments to §1001.10 and <br /> §1011.12 Establishing Micro-Unit Dwellings in Sacred Communities as <br /> Permitted Accessory Uses Subject to Requirements Outlined in Minnesota <br /> State Statutes 327.30 <br /> At the request of Mayor Roe, City Manager Trudgeon briefly highlighted this item <br /> as detailed in the Request for Council Action and related attachments dated October <br /> 23, 2023. <br /> Mayor Roe explained the reason he asked for this item to be removed was that the <br /> ordinance in the packet had one minor, but probably very meaningful technical <br /> correction needed on line 9, "...and designated volunteers that meets the <br /> requirements of Minnesota..." He thought more substantively, in Section 2, the <br /> City was adding language, adding the ability to do the sacred communities into a <br /> sort of general requirement or category in the City's standards language and in <br /> reviewing this, the City does already have in Code a church or religious institution <br /> section under the standards under Civic and Institutional Uses. His suggestion to <br /> make it slightly easier for people to find the language, instead of having this a <br /> standard stand-alone paragraph,to put it in with the church and religious institution. <br /> He noted he checked with staff and the City Attorney, and did not think there was <br /> an issue with doing this. <br /> Councilmember Strahan explained because there is language within the Statute that <br /> indicates the percentage of people that need to be designated volunteers versus <br /> those who are experiencing chronic homelessness, she knew it is within the Statute <br /> and could change at any time, but wondered if there was any reason or need to <br /> include that particular piece within this. <br /> Mayor Roe deferred this to staff and the City Attorney, but he thought in cases <br /> where the City is referencing State Statutes, it is generally wise to be as general as <br /> possible in case the Statute itself changes. <br /> Mr. Trudgeon indicated staff would concur. <br /> Public Comment <br /> With no one requesting to speak, Mayor Roe closed the public comment. <br />
