The City shall also have the right to bring a civil action or other <br /> remedies to collect unpaid charges, fees, and penalties. <br /> F. Hearing Required. A hearing must be held prior to the certification of unpaid <br /> utility charges to the Count Auditor. Unpaid charges on sewer and water <br /> accounts will not be certified to the County Auditor until notice and <br /> opportunity for a hearing have been provided to the owner of the premises <br /> involved. The notice will be sent by first class mail and must state that if <br /> payment is not made before the date of certification, the entire unpaid amount, <br /> plus penalties, will be certified to the County Auditor for collection as other <br /> taxes are collected. The notice will also state that the occupant may, before <br /> such certification date, attend or schedule a hearing on the matter to object to <br /> certification of unpaid utility charges. <br /> G. Delivery to County. If, after the hearing, the City Council finds that the <br /> amounts claimed as delinquent are actually due and unpaid and that there is no <br /> legal reason why the unpaid charges should not be certified for collection with <br /> taxes in accordance with this ordinance, the City may certify the unpaid <br /> charges and any accrued penalty charges to the County Auditor for collection <br /> as other taxes are collected. <br /> HF. Utility Rate Discount: The City Council may establish reduced water and <br /> sewer rates for owner-occupied homes that meet financially need-based criteria as <br /> established by the City Council from time to time. <br /> SECTION 2: Effective date.
