<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 7/24/2023 <br />Item No.: 7.a. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider a resolution approving an Interim Use for Prince of Peace Lutheran <br />Church to temporarily allow two mobile residential micro-unit dwellings at 2555 <br />Victoria Street (PF23-004). <br />1 <br />2 Background <br />3 In December 2022, two mobile residential dwelling units (hereinafter referred to as “micro-unit <br />4 dwellings”) were placed on the 2.25-acre vacant parcel addressed 2555 Victoria Street N immediately <br />5 south, and in common ownership of Prince of Peace Lutheran Church located at 2561 Victoria Street <br />6 N. <br />7 <br />8 A “micro-unit” is defined in the recently adopted legislation by the State of Minnesota as a mobile <br />9 residential dwelling providing permanent housing within a “sacred community”. A “sacred community” is <br />10 defined (and which Prince of Peace has established) as a residential settlement established on or <br />11 contiguous to the grounds of a religious institution’s primary worship location primarily for the purpose of <br />12 providing permanent housing for chronically homeless persons, extremely low-income persons, and <br />13 designated volunteers. <br />14 <br />15 Prior to adoption of the State legislation, the City of Roseville determined the micro-unit dwellings were <br />16 prohibited under the current City Code and on February 1, 2023 sent a letter notifying Prince of Peace <br />17 that the units were not legal dwelling units under certain City Code and Zoning Code standards (see <br />18 Attachment 4). Prince of Peace appealed the staff determination and on March 6, 2023, the City Council, <br />19 acting as the Board of Adjustments and Appeals, held a public meeting on the appeal and upheld the <br />20 staff determination. <br />21 <br />22 During this same time frame, the Minnesota State Legislature was considering legislation that would <br />23 require cities to allow such units and would establish statewide standards for sacred communities and <br />24 micro-unit dwellings. The legislation has since been adopted and becomes effective January 1, <br />25 2024. However, the Roseville City Council, in approving their resolution regarding the determination of <br />26 non-compliance, requires Prince of Peace to obtain an approved Interim Use (IU) to regulate the micro- <br />27 unit dwellings through the end of this year. The intention of the Interim Use is to regulate these micro- <br />28 unit dwellings in a manner consistent with the legislation slated to go into effect on January 1, <br />29 2024. Attachment 1, containing the Planning Commission’s written report and supporting <br />30 documentation, outlines how the already established sacred community and micro-unit dwellings comply <br />31 with the regulations provided in the new law. <br />32 <br />33 Policy Objectives <br />34 Certain land uses might not be consistent with the land uses designated in the Comprehensive Plan, <br />35 and they might also fail to meet all of the zoning standards established for the district within which they <br />36 are proposed; some such land uses may, however, be acceptable or even beneficial if reviewed and <br />37 provisionally approved for a limited period of time. The purpose of the interim use review process is to <br />38 allow the approval of interim uses on a case-by-case basis; approved interim uses shall have a definite <br />39 end date and may be subject to specific conditions considered reasonable and/or necessary for the <br />Page 1 of 3 <br />Qbhf!21!pg!377 <br /> <br />
