<br />40 protection of the public health, safety, and general welfare. <br />41 <br />42 Racial Equity Impact Summary <br />43 Racial equity impacts were not evaluated for this request. <br />44 <br />45 Budget Implications <br />46 Not Applicable <br />47 <br />48 Staff Recommendations <br />49 On July 5, 2023, the Roseville Planning Commission held the duly noticed public hearing on the Interim <br />50 Use request by Prince of Peace in support of regulating two existing micro-unit dwellings at 2555 <br />51 Victoria Street (Attachment 1). <br />52 <br />53 At the hearing, no individuals addressed the Commission other than the applicant’s <br />54 representatives. Planning Commissioner McGehee asked questions of the applicant concerning the <br />55 extent of the liability insurance and the certifications provided on the micro-unit dwellings, as well as <br />56 expressing overall opposition to the allowance for sacred communities and micro-unit dwellings under <br />57 the new law (Attachment 2). The Planning Commission voted 6-1 (Commissioner McGehee dissented) <br />58 to recommend approval of the IU to the City Council, subject to the following conditions: <br />59 1. The IU expires on December 31, 2023; and <br />60 2. Two micro-unit dwellings, instead of three, are permitted until December 31, 2023; and <br />61 3. The Prince of Peace sacred community meets all requirements of the Sacred Communities and <br />62 Micro-Unit Dwellings legislation which goes into effect on January 1, 2024. <br />63 <br />64 <br />65 Requested Council Action <br />66 By motion, adopt a Resolution approving an Interim use pursuant to §1009.03.D of the Roseville City <br />67 Code for the existing Sacred Settlement and two micro-unit dwellings on property owned by Prince of <br />68 Peace Lutheran Church located at 2555 & 2561 Victoria Street based on the comments and findings of <br />69 the Planning Commission’s written report dated July 5, 2023 and City Council’s written report dated July <br />70 24, 2023, and the following conditions: <br />71 1. The IU expires on December 31, 2023; and <br />72 2. Two micro-unit dwellings, instead of three, are permitted until December 31, 2023; and <br />73 3. The Prince of Peace sacred community meets all requirements of the Sacred Communities and <br />74 Micro-Unit Dwellings legislation which goes into effect on January 1, 2024. <br />75 <br />76 Alternative Actions <br />77 1. Pass a motion to table the item for future action. An action to table must be tied to the need of <br />78 clarity, analysis and/or information necessary to make a recommendation on the request. Tabling <br />79 beyond September 2, 2023, would require extension of the 60-day action deadline established in <br />80 Minn. Stats. 15.99. <br />81 2. Pass a motion denying the proposal.
